~" For the Upper Segment, the description of upstream
and downstream points of minimum stream flow reach claimed: The
upstream point is the confl)X~nce with North Beaver Brook in the
NW/4 NE/4 S14 T4S R72W 6PM. The downstream point is the con-
fluence with Soda Creek in the SE/4 NW/4 S8 T4S R71W 6PM. For
the Lower Segment, description of upstream and downstream points
of minimum stream flow reach claimed: The upstream point is the
confluence with Soda Creek in the SE/4 NW/4 S8 T4S R71W 6PM. The
downstream point is the confluence with Clear Creek in the NE/4
NW/4 S3 T4S R71W 6PM,/ The total distance of the instream flow
reach is 6.2 miles.

5. Use of the water is for instream flows to preserve
the natural environment to a reasonable degree.

6. The date of initiation of appropriation for both the
Upper Segment and the Lower Segment is December 11, 1987.

7. The amount of water claimed is:

A. For the Upper Segment: 0.5 c.f.s. (April 16 -
July 31); 0.25 c.f.s. (August 1 - April 15), both ab-
solute.

B. For the Lower Segment: 1.5 c.f.s. (April 16 -
July 31); 1.0 c.f.s. (August 1 - April 15), both ab-
solute.

8. The water was first applied to the above beneficial
use December 11, 1987, by action of the Colorado Water Conserva-
tion Board under the provisions of ~~ 37-92-102(3) and V S\o.~ drr<W2Jl~)
37-92-103(3),(4),(10), C.R.S. (1990). In'SkNm,u..-d.

9. The minimum instream flow appropriations on Beaver
Brook described above are subordinate to the District's right to
operate the proposed exchange described in the application filed
in Case No. 87-CW-303 without regard to the priority dates that
may ultimately be decreed in Case Nos. 87-CW-272 and 87-CW-303;
subject to paragraph 10 below.

10. At any time during the period April 16 through July
31 when flows in the Upper Segment are less than 0.5 c.f.s., or
at any time during the period August 1 through April 15 when
flows in the upper segment are less than 0.25 c.f.s., the Dis-
trict shall . bypass at the District's Beaver Brook Pipeline on
