<br />. <br /> <br />. <br /> <br />No. 87CW272 <br />Colorado Water Cons. Board <br /> <br />North Beaver Brook, as much water as is required, up to the natu- <br />ral flow of North Beaver Brook at the said Pipeline, to satisfy <br />the applicable instream flow on the Upper Segment. Such bypass <br />may require a complete cessation of all diversions by the Dis- <br />trict from North Beaver Brook if such is necessary to partially <br />or fully satisfy the applicable instream flow. This requirement <br />shall apply to the District's right to divert water from North <br />Beaver Brook under the exchange proposed in Case No. 87-CW-303, <br />District Court, Water Division 1 and to the District's right to <br />divert water under any other water right owned or controlled by <br />the District having a point of diversion on North Beaver Brook, <br />including the water right decreed to the Beaver Brook Pipeline by <br />the District Court, City and County of Denver in Case No. 60052 <br />on May 13, 1936. This paragraph shall not apply to any of the <br />District's water rights having a point of diversion on Beaver <br />Brook (a/k/a South Beaver Brook). Prior to enforcement of the <br />bypass described above, the CWCB shall install and maintain flow <br />measuring devices on the Upper Segment acceptable to the Division <br />Engineer to enable the Division Engineer to enforce the provi- <br />sions of the parties' Stipulation. <br /> <br />The Referee rules that this application should be granted, <br />and for the Upper Segment an absolute decree for 0.5 c.f.s. <br />(April 16 - July 31) and 0;'25 c.E.s. (August 1 - April 15); and <br />for the Lower Segment an absolute decree for 1.5 c.f.s. (April 16 <br />- July 31), and l.O c.f.s. (August 1 - April 15), is hereby <br />awarded for the purpose of maintaining an instream flow to pre- <br />serve the natural environment to a reasonable degree on Beaver <br />Brook, between the upstream and downstream points as described in <br />paragraph 4 above, with an appropriation date of December 11, <br />1987. The Applicant shall install and maintain such measuring <br />devices and maintain such records as the Division Engineer may <br />require for administration of this right. <br /> <br />w <br /> <br />It is accordingly ORDERED that this Ruling shall be filed <br />with the Water Clerk subject to Judicial review. <br /> <br />It is further ORDERED that a copy of this Ruling shall be <br />filed with the Division 1 Engineer and the State Engineer. <br /> <br />day of <br /> <br />, :' - Q l~c:; <br />... oJ .........,. <br /> <br />1992. <br /> <br />DATED this <br /> <br />-3- <br />
