<br />Draft 4 <br /> <br />8.2 <br /> <br />Enforcement and Benalitie~. <br /> <br />'!he Adninistrator is hereby anpowered ad directed to <br />insp:!ct and examine the use, occup:ltion, or <br />developnent of floodplains subject to these <br />regulations for the plrpose of determining from time <br />to time whether ay use, occup:ltion, developnent, or <br />activity is in violation of any of the prOlTisions of <br />these regulations or any permit issued or required <br />plrsuant to these or other applicable regulations. <br /> <br />Prior to the issuance of a Certificate of OcCUp:lIlC:Y <br />or a Certificate of Zoning Compliance, the structure <br />is to be insp:!cted to assure that it was built in <br />full COIIIpliance with the applicable floodplain <br />managanent requiranents In addition, the Frisco <br />Building Official, is to require that the Applicant <br />obtain a certificate fran a registered professional <br />or licensed land surveyor, licensed in the state of <br />Colorado, indicating the as-built elevation of the <br />lowest floor of any building .Qt. the as-buil t <br />floodproofed elevation of any floodproofed <br />non-residential structure located in the floodplain. <br /> <br />If a violation of these regulations is found to <br />exist, for any land use, in accordance with the <br />provisions of Section 9 of these regulations, the <br />l\dministrator shall by written order direct that <br />ranedial action be taken immediately to result in <br />fill COIIIpliance of that land use with the' applicable <br />prOlTisions of these regulations. However, the <br />,issuance of such order shall in no way or manner be <br />enforcement proceedings as are set forth in these <br />regulations1 and prOlTided further, that COIIIpliance <br />with such order shall not necessarily be deemed to <br />be a defense to any alleged violation of these <br />regulations in any court action instituted seeking <br />full COIIIpliance therewith. <br /> <br />8.3 Violations and Remedial l\ctions. It is unlawful to <br />erect, construct, reconstruct, alter, maintain, or <br />use any building or structure or to use any land in <br />violation of these regulations. Any violation of <br />these regulations is punishable by a fine or <br />imprisonnent as prOlTided by CRS 30-28-124 and <br />31-16-101. <br /> <br />'!he Frisco Town Board of Trustees has power to <br />< enforce these regulations as prOlTided by 31-16-101, <br />and may restrain and prevent occup:lIlc:y of said <br />building, structure, or land and require correction <br />as prOlTided in CRS 31-23-301 (1) and CRS 31-23-308. <br /> <br />Page 23 <br />
