<br />8.1.2 <br /> <br />Draft 4 <br /> <br />Variances shall only be issued up:ln a determination <br />that the variance is the mininurn necessary, <br />considering the flood hazard, to afford relief. <br /> <br />Variances shall, only be issued upon: <br /> <br />a. A showing of good and sufficient cause; <br />b. A determination that failure to grant the <br />variance would result in exceptional hardship <br />to the applicant; and, <br />c. A determination that the granting of a variance <br />will not result in increased flood heights, <br />additional threats to public safety, <br />extraordinary public expense, create nuisances, <br />cause fraud on or victimization of the ~ic <br />as identified in Section , or conflict <br />with existing local laws or ordinances. <br /> <br />Any applicant to whan a variance is granted shall be <br />given written notice that the structure will be <br />~rmitted to be built with a lowest flood elevation <br />below the base flood elevation and that the cost of <br />flood insurance will be commensurate with the <br />increased risk resulting fran the reduced lowest <br />floor elevation. <br /> <br />AJ;>.IiE'al s. An applicant for a floodplain <br />developnent ~rmit or any persons claiming to <br />be affected by the granting or denial of any <br />such a permit may ap~al such granting or <br />denial. Anyone wishing to request changes to <br />or rejection of the official maps and the base <br />flood elevation, or any F8rt thereof, may <br />ap~al the maps. Ap~als shall be filed with <br />the Administrator, and engineering and <br />technical data shall be' furnished to support <br />the ap~al. After the engineering and <br />technical data have been reviewed by the <br />Administrator, the Colorado Water Conservation <br />Board, and the Federal &nergency Management <br />Agency and found to be accurate, the official <br />map and base flood elevations will be amended <br />and redesignated by the Colorado Water <br />Conservation Board. Ap~als that are denied by <br />the Administrator may be brought to the Ap~als <br />Board within thirty days of the granting or <br />denial of such permit. <br /> <br />Page 22 <br />
