<br />412. PROTECTION OF PUBLIC AND PRIVATE pROPERTY <br /> <br />All property, publ ic or private, shall be protected from damage by the <br />Contractor. Property damage by the ContY'actor during the construction of <br />the work, whether such damage occurs to property of the Owner Or adjacent <br />land owners, shall be repaired, replaced and restored by the Contractor, at <br />his sole cost and expense, and left in as good condition as found. <br /> <br />413. FEES AND PERMITS <br /> <br />The Contractor, prior to commencing any Nork, shall secure at this o,m <br />expense all the necessary fees and permits required for the performance of <br />the work. <br /> <br />Contractor shall assume full responsibility for paying all costs incurred <br />for inspection, testing or approvals by any public body having jurisdiction <br />by law, ordinance, rule, regulation, code or order, over all or any part of <br />the work. <br /> <br />414. WASTE MATERIALS <br /> <br />The Contractor shall clean-up any debris created by his construction <br />activities and shall dispose of same in suitable trash containers on a daily <br />basis. Should the Contractor fail to maintain the construction area in a <br />suitable manner, the Owner will have the right to contract with a third <br />party and withhold any amounts incurred fr~m the Contractor's payment. The <br />Contractor shall keep soil, debriS, trash and accumulation of construction <br />items from the church property from cominq into or contaminatin" the gulch <br />and the wetlands area as it is prerJared under' this contract. <br /> <br />Final clean-up must be approved and accepted by the Owner before the contract <br />may be considered complete. <br /> <br />415. INTERPRETATION OF ESTIMATED QUANTIfIES <br /> <br />Bidders are cautioned that the estimated quantities in the Bidding Schedule <br />are approximate only. The basis of payment \vill be based on a lump sum cost. <br /> <br />416. OPERATIONS WITH OTHERS <br /> <br />The Owner reserves the right to have other \'lork performed by other Contractors <br />and to permit the publ ic util ity companies and others to do work adjacent to <br />or within the site. The Contractor shall conduct his operations and shall <br />cooperate with the other parties so as to min-imize interferences with this <br />other work. <br /> <br />417. CONSTRUCTION LIMITS <br /> <br />The Contractor shall confine this operation within the limits of construction <br />show~ on the Plans. Site offices, workshops, material and equipment storage, <br />parklng for employees, etc.. shall be located within a "Construction Staoing <br />Area". Where haulage roads cannot be confined to existing established <br /> <br />SC-3 <br />
