<br />308.2.3 Acceptance of Defective Work <br /> <br />The Owner may choose to accept defective work rather than requiring its <br />correction or removal and replacement. If the Owner so chooses, an <br />appropriate deduction in the Contract Price shall be made. <br /> <br />309. SAFETY OF PERSON - PROTECTION OF PROPERTY <br /> <br />309.1 Public Convenience and Safety <br /> <br />309.1.1 The Contractor shall be solely and completely responsible for conditions <br />at the Project Site, including all safety precautions and programs in <br />connection with the Project. He shall be responsible foy' preventing <br />damage, harm, injury or loss to all people on the Project Site; all <br />Work, materials and equipment used in the Project or stored on or off <br />the Project Site; other property at the Project Site or adjacent thereto. <br />This requirement will not be 1 imited to working hours and will apply <br />continuouSly twenty-four (24) hours a day until issuance of a Certifi- <br />cate of Final Completion by the Owner. <br /> <br />309.1.2 The Contractor shall at all times conduct the Work so as to cause <br />minimum amount of inconvenience to the public by way of 'interference <br />with traffic, interruptions of the use of sidewalks, or ob~;truction of <br />gutters, Sewer inlets, drainage or' irrigation ditches. <br /> <br />309.1.3 The Contractor shall at all times be l"esponsible for complying with all <br />applicable laws, ordinances, rules, regulations and orders of any public <br />body having jurisdiction for the safety of persons or property. <br /> <br />309.2 Warning Devices <br /> <br />The Contractor shall provide all necessary signs, barricades, lights or <br />watchmen necessary to fulfill his obl'igations of safety and publ ic <br />convenience. <br /> <br />309.,3 <br /> <br />Notice to Owner and Utilities <br /> <br />309.4 <br /> <br />If the work of anyone on the Project Site will in any way affect other <br />property owners or the provision of services by util ity companies, the <br />Contractor shall notify the property o~lners and util ity companies before <br />any Work is commenced which may affect these parties or their property. <br /> <br />Explosives <br /> <br />If explosives or other hazardous materials or equipment are to be used <br />or stored at the Project Site, the Contractor shall use the utmost care <br />to prevent any injury to damage to persons or property caused by such <br />materials or eqUipment. No explosives or hazardous materials are to be <br />used or stored at the Project Site without express written authorization <br />of the Owner. <br /> <br />GC - 12 <br />
