<br />heat, telephone, sanitary facilities and all other facilities and <br />incidentals necessary for the execution, testing, completion, and initial <br />operation of the Project; (7) to employ only those Subcontractors and <br />others supplying equipment, materials and/or labor that are approved b <br />the Owner before execution of the Owner-Contractor Agreement, or those <br />later approved of in writing by the Owner; (8) to be fully responsible <br />for all of the acts and omissions of Subcontractors and persons employed <br />by them; (9) to obtain all necessary 1 icenses and pay any necessary <br />royal ties and fees incident to th,= performance of the Contractor's <br />responsibil ities; (10) to obtain and pay for all construction permits <br />and licenses; (11) to pay all sales, consumer" use and other similar <br />taxes required to be paid by the law of the place Ivhere the ,Iork is to <br />be performed or materials are to be stored, or, in lieu thereof, to <br />obtain any appropriate tax exemption certificates; (12) to protect the <br />materials and equipment during construction; (13) to provide one complete <br />set of drawings and specifications for the Project on the Project Site <br />and to make it available to the EnginE'er at all times; (14) to allow the <br />Engineer access to the Project Site and to furnis,h the Engineer with all <br />materials requested; (15) to fulfill all other responsibi'lities arising <br />out of any portion of this Contract. <br /> <br />302.3 Engineer <br />302.3.1 Definition <br /> <br />The person or entity I icensed to pet"form engineering services in the <br />State of Colorado and named as such in the Owner-Contractor Agreement. <br /> <br />The Owner and Contractor expressly agree <br />that the Engineer shall have the following <br />authority: <br /> <br />302.3.2 (1) Have access to the Project Site at 0,11 times during construction; <br />(2) visit the Project Site at interva'ls agreed to by the Owner and <br />Engineer, (or, in the absence of such agreement, at intervals) appropriate <br />to the various stages of constructicn, to observe progress of the <br />Project, observe quality of materials and workmanship and to observe the <br />progress of the work in accordance with the Contract Documents; observe <br />for defective Work and materials, and observe all proper materials and <br />Work done in accordance with the Contract; (3) keep the Owner informed <br />of all progress of the Project; (4) issue written clarifications Or <br />interpretations of the Contract when t"equested by the Contractor or on <br />his 0~1n initiative as the Owner's representative; (5) examine all <br />requests for progress payment presented by the Contractor and either <br />approve or disapprove payment within ten (10) days of receipt; (5) <br />review all requests for final payment according to Section 306; (7) <br />review prel iminary schedules submitted by the Contractor for the submis- <br />sion of Shop drawings and completion of the Project; (8) recommend the <br />Owner issue the Certificate of Substant'ial Completion; (9) recommend the <br />Owner i~s~e.t~e Certificate?f Final Completion; (10) fulfill any other <br />responslbllltles that may arlse out of any other po)"tion of this Contract. <br /> <br />GC - 5 <br />
