<br />302.1.2 <br /> <br />(1) To have the Project completed in substantial compliance with the <br />Contract terms, within the time period specified in the Owner-Contractor <br />Agreement, upon fulfillment of Owners duties to make payments when due; <br />(2) to suspend work on the Project upon written notice to the Contractor <br />according to the terms of Section 318; (3) to terminate the Contract <br />according to the terms of Section 318; (4) to complete the project in <br />any reasonable manner after termination of th,? Contract by any party; <br />(5) to make use of completed portions of the Project Site by the <br />Engineer; (7) to have disputes bet\~een the Owner and Contractor regarding <br />the work and materials decided by the Engineer; (8) to withhold payment <br />to the Contractor until proper payment requests are submitted by the <br />Contractor and approved by the Engineer in accordance with Section 306 <br />of this Contract; (9) to have all rights and remedies against any and all <br />parties, whether or not the parties to th-is Contt'act, unless speci fically <br />waived by express language in the Contract; (10) any rights arising out <br />of any other portion of this Contract. <br /> <br />The Owner and Contractor expressly agree that the <br />following shall be the sole responsibility of the <br />Owne r: <br /> <br />302.1.3 (1) To obtain all funds necessary to complete the Project; (2) to issue <br />all communications to the Contractor through the Engineer; (3) to <br />furnish all data required by the Contract Documents; (4) to furnish all <br />lands, rights-of-way and easements necessary fOI" the completion of the <br />Project in accordance with Section 315; (5) to make all payments to the <br />Contractor less any retainage agreed to by the parties or required by <br />law within Thirty (30) days of receipt of an approved payment request <br />from the Engineer; (6) to fulfill any other responsibilities arising out <br />of the Contract Documents. <br /> <br />302.2 Contractor <br /> <br />302.2.1 Definition <br /> <br />The person or entity with whom the Owner has contracted for performance <br />of the Project. The term "Contractor" shall also include the authorized <br />agent of the Contract, but not one employed by the Contractor as a <br />Subcontractor. <br /> <br />The Owner and Contractor expressly agree <br />that the following shall be the sole <br />responsibility of the Contractor: <br /> <br />302.2.3 (1) To perform all work according to the Contract Documents; (2) to <br />supervise, direct and control the Work; (3) to have sole responsibi1 ity <br />for the means, methods, techniques, sequences and procedures of construc- <br />tion; (4) to cooperate with and b,? bound by decisions of the Engineer <br />relating to any disputes, questions or other matters arising out of the <br />contract; (5) to be represented n the Project Site at all times work is <br />in progress; (6) to provide all materials, equipment, labor, transporta- <br />tion, construction equipment, tools, appliances" fuel, power, 1 ight <br /> <br />GC - 4 <br />
