<br />ClIlORAllO FlOOO CONTROL <br />AND IlRAIIWlE lAWS <br /> <br />DEFINITIONS <br /> <br />The planning commission shall adopt sUbdivision <br />regulations to exercise power over sUbdivisions <br />covering arrangement of streets in relation to <br />existing and planned streets and the master plan. <br />spaces for traffic, utilities. fire fighting access. <br />recreation. light and air. and avoidance of <br />congestion of population. including lot area and <br />widths. These regulations may provide waivers. for <br />different regulations for different sizes. densities <br />or types of dwelling units. However. regulations for <br />areas outside the municipality shall provide only <br />for conformance with the major str.eet plan <br />(31-23-214) . <br /> <br />The planning commission shall not accept any street. <br />paved or improved, nor sha 11 any water and sewer <br />connections or mains be laid unless they have been <br />legally accepted pdor to the adoption of a major <br />street plan. or corresponds with the official master <br />plan or major street plan (31-23-217). <br /> <br />The planning commission shall not issue a building <br />permit in an area for which there is a major street <br />plan. within the municipality. unless the street <br />serving the building has been accepted or <br />corresponds with the plan (31-23-218). <br /> <br />The planning commission may. after aCloption of a <br />major street plan. make surveys to determine the <br />exact location of future streets planned. and <br />reserve the locations for future acquisition. <br />Compensation of the surveys may be paid as provided <br />in the statute (31-23-220--224). <br /> <br />"Subdivision" means any parcel of land which is to <br />be used for condominiums. apartments. or any other <br />multiple dwelling units. unless such land was <br />previously subdivided and the filing accompanying <br />such SUbdivision compiled with municipal regulations <br />applicable to subdivisions of substantially the <br />same density. or the division of a lot. tract. or <br />parcel of land into two or more lots. plats. sites. <br />or other divisions of land for the purpose. whether <br />immediate or future. of sale or of building <br />development. It includes resubdivisioll and. when <br />appropriate to the context. relates to the process <br />of SUbdividing or to the land or territory <br />subdivided."
