<br />COLORADO FLOOD CONTROL <br />AHO DRAINIIGE lAWS <br /> <br />TOPIC TITLE <br /> <br />STATUTES <br /> <br />PURPOSES <br /> <br />MUNICIPAL PLANNING AND ZONING <br /> <br />31-23-101-313 <br /> <br />For the promotion of health, safety, morals, or the <br />general welfare of the community, including the <br />promotion of energy conservation and solar energy. <br />zoning power is granted. to regulate the physical <br />features of buildings, density of population, open <br />spaces, and trees and vegetation. Also: <br /> <br />"to the end that adequate safety may be secured, <br />power to establish, regulate, restrict. and limit <br />such uses on or along any storm or floodwater runoff <br />channel or basin, such as storm or floodwater runoff <br />channel has been designated and approved by the <br />Colorado Water Conservation Board, in order to <br />lessen or avoid the hazards to persons and damage to <br />property reSUlting from the accumulation of storm or <br />floodwaters" (31-23-301). <br /> <br />As well as zoning, municipalities may use master <br />plans (see below) based on studies of present and <br />future conditions, for the general purpose of: <br /> <br />"guiding and accomplishing a coordinatl!d, adjusted, <br />and harmonious development of the municipa 1 i ty and <br />its environs which will. in accordance with present <br />and future needs, best promote health. safety, <br />morals, order. convenience, prosperi ty. and genera 1 <br />welfare, as well as efficiency and economy in the <br />process of development. includ ing, among other <br />things. adequate provision for traffic. the <br />promotion of safl~ty from fire, flood waters. and <br />other dangers..." (31-23-207). <br /> <br />Municipalities may engage in zoning without the <br />development of a master plan and the use of only a <br />zoning plan. Zoning regulations must be made in <br />accordance with a comprehensive plan (31-23-303), <br />which has many of the same purposes as a master plan <br />generated under the planning provisions. However. <br />zoning power without planning applies only wi thin <br />the municipality and lacks the extraterritorial <br />authority and reservation authority that planning <br />and zoning commissions have. <br /> <br />II-A-l <br />
