COLORADO LAND USE ACT

24-65-101--106 (original enactment 1970)

In order to respond to the rapid growth and
development in the State. new and innova t i ve
measures are declared necessary to:

o encourage use of land and natural resources in
accordance with their character;

o conserve soil. water. and forest resources;

o promote efficient and economical use of pUblic
resources;

o coordinate and unify pOlicies in planning for
growth and development; and

o to adopt a

This statute also provides emergency authority for
the Governor and the Colorado Land Use Commission to
intervene. in certain conditions. when a threat to
safety is indicated.

The Colorado Land Use Commission is given temporary
authori ty as an E!mergency power to develop a total
land use planning system for the State. including
pOlicies and implementation techniques by December
1973 (24-65-104).

The Commission is given authority to request that
the Governor review any land development activity
posing a serious threat to pUblic health and
welfare. if the Commission's written notice to the
county commissioners does not result in a remedy of
the condition or threat. The Governor" on review.
may direct a cease and desist order by the
Commission. If necessary. the Commission may also
apply for a court restraining order. After the
activity is halted. the Commission shall proceed
immediately to develop planning criteria necessary
to eliminate or avoid the danger; the local
governmental agency shall then implement the
criteria. If the development is wholly .lithin a city
or town. the city government shall act in place of
the county commissioners. (24-65-104).
