<br />COLllRAllO FLOOO CONTROL <br />NIl DRAIIW>E lAWS <br /> <br />TOPIC TITLE <br /> <br />STATUTES <br /> <br />PURPOSES <br /> <br />RELATED TOPICS <br /> <br />SPECIAL POWERS <br /> <br />COLORADO LAND USE ACT <br /> <br />24-65-101--106 (original enactment 1970) <br /> <br />In order to respond to the rapid growth and <br />development in the State. new and innova t i ve <br />measures are declared necessary to: <br /> <br />o encourage use of land and natural resources in <br />accordance with their character; <br /> <br />o conserve soil. water. and forest resources; <br /> <br />o promote efficient and economical use of pUblic <br />resources; <br /> <br />o coordinate and unify pOlicies in planning for <br />growth and development; and <br /> <br />o to adopt a <br />(24-65-102). <br /> <br />Statewide <br /> <br />use <br /> <br />of <br /> <br />land <br /> <br />system <br /> <br />This statute also provides emergency authority for <br />the Governor and the Colorado Land Use Commission to <br />intervene. in certain conditions. when a threat to <br />safety is indicated. <br /> <br />Areas and Activities of State Interest. I-D; <br />Municipal Planning and Zoning. topic II-A; <br />County Planning and Zoning. topic II-B. <br /> <br />The Colorado Land Use Commission is given temporary <br />authori ty as an E!mergency power to develop a total <br />land use planning system for the State. including <br />pOlicies and implementation techniques by December <br />1973 (24-65-104). <br /> <br />The Commission is given authority to request that <br />the Governor review any land development activity <br />posing a serious threat to pUblic health and <br />welfare. if the Commission's written notice to the <br />county commissioners does not result in a remedy of <br />the condition or threat. The Governor" on review. <br />may direct a cease and desist order by the <br />Commission. If necessary. the Commission may also <br />apply for a court restraining order. After the <br />activity is halted. the Commission shall proceed <br />immediately to develop planning criteria necessary <br />to eliminate or avoid the danger; the local <br />governmental agency shall then implement the <br />criteria. If the development is wholly .lithin a city <br />or town. the city government shall act in place of <br />the county commissioners. (24-65-104). <br /> <br />I-E-l <br /> <br />" <br />
