<br />COLORADO FLOOD CONTROL <br />All) DRAINAGE LNIS <br /> <br />LIMITATIONS <br /> <br />No floodplain shall be designated <br />government without approval by the <br />Conservation Board. as provided in <br />31-23-301 (24-65.1-403) <br /> <br />by any local <br />Colorado Water <br />30-28-111 and <br /> <br />After the required hearing, the local government may <br />act to designate o.r not to designate. or. adopt the <br />proposed designation with modifications, but a local <br />government must designate a matter which has been <br />finally determined to be of State interest, and must <br />adopt guidelines for its administration <br />(24-65.1-104). <br /> <br />After designation, any person seeking to develop in <br />an area of State concern, or to conduct an activity <br />of State concern must file an application for a <br />permi t from the local government; the permi t sha 11 <br />be denied if the proposed development does not <br />comply with guidelines and regulations (24-65.1-501) <br /> <br />If a person proposes to develop in an area of State <br />interest. or conduct an activity of State interest <br />not previously designated and for which guidelines <br />have not been adopted, the local government may hold <br />one hearing for the designation determination and <br />guideline adoption and permit granting or denial <br />(24-65.1-501). <br /> <br />Nothing in this statute shall be construed as <br />enhancing or diminiShing powers and authority of <br />local governments or the PUblic Utilities Commission <br />in regard to utility regulation. or utility powers <br />of eminent domain, but utilities and the PUblic <br />Utility Commission shall. when feasible, comply with <br />adopted land use master plans (24-65.1-105). <br /> <br />This statute shall not affect property or water <br />rights (24-65.1-106). <br /> <br />This statute shall not apply to any development in <br />an area of State interest, or the conduct of an <br />activity of State interest which. as of May 17. <br />1974, had a current building permit, has been <br />approved by the electorate, or was to be on land <br />approved for such use as a planned unit development. <br />had been zoned for the contemplated use. or had a <br />development plan either conditionally or finally <br />approved (24-65-107). <br /> <br />1-0-5 <br />
