<br />COLORADO fLOOO CONTROl. <br />AND DRAINAGE l.AIIS <br /> <br />NOTE <br /> <br />DEFINITIONS <br /> <br />FORMATION <br /> <br />ADMINISTRATION <br /> <br />Local governments may designate that efficient <br />utilization of municipal and industrial water <br />projects are activities of State interest. <br />Administration of such projects shall emphasize the <br />most efficient use of water including permissible <br />recycling and reuse. "Urban development. population <br />densities. site layout and design of storm water and <br />sanitation systems shall be accomplished in a manner <br />that will prevent the pollution of aquifer recharge <br />areas". (14-65.1-;~03. -204; quotation from section <br />204(8)). <br /> <br />The Colorado Land Use Commission may initiate <br />identification of matters of State interest by <br />submission of a formal request to the local <br />government with regard to a specific matter. The <br />receipt of the request halts the development until <br />the local government has conducted the required <br />hearing and responded to the request. If the local <br />government fails to designate the matter as one of <br />State interest. or does so but fails to adopt <br />management guidelines pursuant to this statute. the <br />commission may seek judicial review. and no <br />development is allowed during the pendency of the <br />jUdicial proceedings (24-65.1-407). <br /> <br />It is important that local governments implement <br />this statute by designation of matters of State <br />interest in order to gain the additional regulatory <br />powers; before designation is made. only the land <br />use commission can act to seek implementation. and <br />this may be limited in practice. <br /> <br />This statute has a large number <br />including definitions of natural <br />potential designation. such as: <br /> <br />of definitions <br />hazards. for <br /> <br />o Floodplain means an area adjacent t.o a stream. <br />which is subject to flooding as the result of the <br />occurrence of an intermediate regional flood and <br />which area is so adverse to past. current. or <br />foreseeable construction or land use as to <br />constitute a significant hazard to pUblic health <br />and safety or property. The term includes but is <br />not limited to:..."(24-65.1-103(7)). <br /> <br />No new bodies are created by this statute. or by the <br />exercise of the authority granted. <br /> <br />The functions of local government are specified. and <br />they include designation of mattere: of State <br />interest. in consideration of foreseeable develop- <br />ment pressures and guidelines for designation <br /> <br />I-D-3 <br />
