<br />COLORADO flOOD CONTROL <br />AND DRAINAGE lMdS <br /> <br />DEFINITIONS <br /> <br />o Municipalities have the power without election <br />approval, to: <br /> <br />acquire, by qift. purchase, or condemnation or <br />lease, and to construct, recons truct, or <br />improve and extend water facilities and <br />sewerage facilities. within and without the <br />municipality (see definitions, below); <br /> <br />operate and maintain water facilities or <br />sewerage facilities or both, 1'01: use within <br />and without the municipality (see definitions, <br />below) ; <br /> <br />accept loans or grants from the U.S. for <br />planning, ,angineer ing and construction of <br />water facilit.ies and sewerage facilities (see <br />definitions below); <br /> <br />enter J01nt operating agreements, <br />or arrangements with consumers for <br />and operation of facilities for <br />abatement or other purposes; <br /> <br />contracts, <br />provision <br />pollution <br /> <br />enter into agreements with other <br />municipalities for or concerning planning, <br />construction, lease, acquisition and financing <br />of water facilities and sewerage facilities, <br />and maintenclUce and operation; the contracting <br />municipalities may also agree to create a <br />board or other body for supervision or <br />operation of the facilities (see definitions, <br />below) (31-35-402). <br /> <br />o <br /> <br />Specific powers are <br />water trustees, water. <br />(31-35-511, -512). <br /> <br />reauthorized for municipal <br />and sewer and water boards <br /> <br />o Municipalities have power to compel sewer <br />connections and may assess costs incurred <br />(31-35-601--619). <br /> <br />o Municipalities may provide sewerage <br />services out of the municipality. <br /> <br />system <br /> <br />For part 4 of article 35 of title 31 (31-35-401 et <br />seq.). "'Sewerage facilit.ies' means anyone or more <br />of the various devices used in the collection, <br />treatment, or disposition of sewage or industrial <br />wastes of a liquid nature or storm, flood. or surface <br />drainage waters, including all inlets; collection, <br />drainage, or disposal lines; intercepting sewers; <br />joint storm and sanitary sewers; sewage disposal <br />plants..." and so forth (31-35-401(6)). <br /> <br />I -A--.3 <br />
