DEFINITIONS

o Municipalities have the power without election
approval, to:

acquire, by qift. purchase, or condemnation or
lease, and to construct, recons truct, or
improve and extend water facilities and
sewerage facilities. within and without the
municipality (see definitions, below);

operate and maintain water facilities or
sewerage facilities or both, 1'01: use within
and without the municipality (see definitions,
below) ;

accept loans or grants from the U.S. for
planning, ,angineer ing and construction of
water facilit.ies and sewerage facilities (see
definitions below);

enter J01nt operating agreements,
or arrangements with consumers for
and operation of facilities for
abatement or other purposes;

contracts,
provision

enter into agreements with other
municipalities for or concerning planning,
construction, lease, acquisition and financing
of water facilities and sewerage facilities,
and maintenclUce and operation; the contracting
municipalities may also agree to create a
board or other body for supervision or

For part 4 of article 35 of title 31 (31-35-401 et
seq.). "'Sewerage facilit.ies' means anyone or more
of the various devices used in the collection,
treatment, or disposition of sewage or industrial
wastes of a liquid nature or storm, flood. or surface
drainage waters, including all inlets; collection,
drainage, or disposal lines; intercepting sewers;
joint storm and sanitary sewers; sewage disposal
plants..." and so forth (31-35-401(6)).
