<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />5-103 <br /> <br />Authority <br /> <br />These regulations are adopted pursuant to, inter alia, ~~24- <br />65.l-l0l, et seq., C.R.S. 1973, 8B29-20-101, et seq., C.R.S. 1973, <br />gS30-28-10l; et seq., C.R.S. 1973, and B83l-23-201, et seq., C.R.S. <br />1973. <br /> <br />5-104 Applicability <br /> <br />(1) These regulations apply to applications for permits to <br />engage in development in all designated or regulated <br />flood hazard areas within this jurisdiction. <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />(2) Any person seeking to engage in development in any desig- <br />nate.d or regulated flood hazard area in this jurisdiction <br />shall obtain a permit pursuant to these regulations before <br />seeking any other permit, rezoning, or other action by <br />the jurisdiction. <br /> <br />5-105 Exemptions <br /> <br />(1) The provisions of this chapter shall not apply to or affect <br />any development described in 81-105 of the Administrative <br />Regulations adopted by this jurisdiction, if these regu- <br />lations were adopted pursuant to only 8824-65.1-101, et <br />seq., C.R.S. 1973. <br /> <br />(2) The provisions of this chapter shall not apply to or affect <br />any device or structure reasonably necessary for the diver- <br />sion or storage of water or for flood control or prevention. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(3) The provisions of this chapt~r shall not apply to any non- <br />conforming use existing on the date the area is designated <br />or subjected to regulation, provided that, when such a <br />nonconforming use shall be discontinued for six months or <br />more or a nonconforming structure is damaged or destroyed <br />to the extent of at least fifty (50) percent of the appraised <br />value, any reuse, reconstruction, or replacement of such <br />structure shall be deemed a new use and shall be subject <br />to the provisions of these regulations. <br /> <br />5-106 Relationship to Other Requirements <br /> <br />(1) Nothing in these regulations shall be construed as exemp- <br />ting an applicant for a permit from any other requirement <br />of this jurisdiction or other state or federal laws and <br />regulations. <br /> <br />(2) To the extent that the requirements of these regulations <br />differ from any other applicable requirements, the more <br />restrictive requirements shall apply. <br /> <br />-4- <br />
