<br />I <br />I <br />I <br /> <br />5-201 <br /> <br />I <br />I <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br />I <br />I <br /> <br />I <br />I <br /> <br />I <br /> <br />I <br />I <br /> <br />I <br />I <br />I <br /> <br />Article 2. <br /> <br />Regulations for Different Flood Hazard Areas <br /> <br />Flood Hazard Initial Control Areas <br /> <br />(1) The provisions of this Section 5-201 apply to each flood <br />hazard initial control area shown on the map or maps listed <br />in Article 3 of this Chapter 5. <br /> <br />(2) The governing body of this jurisdiction finds and declares <br />that: <br /> <br />(a) within each such flood hazard initial control area <br />one or more flood hazards exist but that the flood <br />hazard's specific extent has not yet been determined. <br />The boundaries of the flood hazard initial control <br />area may be based, among other things, on physical <br />factors indicating flow and direction of water which <br />may be of flooding significance, historical flooding <br />experience, or other readily available data. <br /> <br />(b) The flood hazard is of such significance that before <br />any proposed development may be permitted in any <br />portion of such area, public health, safety and wel- <br />fare requires that a determination must be made as <br />to whether the site of the proposed development or <br />activity is located in a floodway zone or a low hazard <br />zone. <br /> <br />(3) No person shall engage in any development in any such <br />flood hazard initial control ,area without a permit. Upon <br />receipt of an application for a permit, the administrator <br />shall recommend to the governing body that it cause a <br />determination to be made as to whether the site for the <br />proposed development is located in a floodway zone or a <br />low hazard zone. The governing body shall promptly take <br />such action with respect to such recommendation as may <br />be appropriate and practical. Any application for a per- <br />mit to conduct a development in a flood hazard initial <br />control area shall not be considered complete or be accept- <br />ed unless and until it is accompanied by the results of <br />any studies needed to determine whether the proposed <br />development is located in a floodway zone or a low hazard <br />zone. <br /> <br />(4) The necessary studies referred to in Subsection 5-201(3) <br />of these regulations may be financed by this jurisdiction, <br />the applicant for a permit, or otherwise. <br /> <br />(5) Upon receipt of a completed study of the area which he <br /> <br />-5- <br />
