<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(7) Prohibit the placement of fill, materials and structures <br />which would significantly obstruct flood flows to the <br />potential damage of others or cause potentially damaging <br />debris to be carried downstream. <br /> <br />(8) Protect the public from the burden of avoidable financial <br />expenditures for flood control projects and flood relief <br />measures. <br /> <br />(9) Prevent avoidable business and commerce interruptions. <br /> <br />(10) Minimize damages to public utilities, streets and bridges. <br /> <br />(ll) Minimize victimization of unwary home and land purchasers. <br /> <br />5-102 Definitions <br /> <br />(1) "Applicant" means any person applying for a permit to engage <br />in development in a designated flood hazard area. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(2) "Development" means any construction or activity which <br />changes the basic character or the use of the land on which <br />the construction or activity occur, including, but not <br />limited to, any substantial improvement, use, fill, enc- <br />roachment or alteration. <br /> <br />(3) "Flood hazard area" means one or more of the following: <br />flood hazard initial control area, floodway zone, low <br />hazard zone. <br /> <br />(4) "Flood hazard initial control area" means an area regulated <br />pursuant to 85-201 of these Eegulations. <br /> <br />(5) "Floodplain" means an area in and adjacent to a stream, <br />which area is subject to flooding as the result of the <br />occurrence of an intermediate regional flood and which <br />area thus is so adverse to past, current, or foreseeable <br />construction or land use as to constitute a significant <br />hazard to public health and safety or to property. <br /> <br />(6) "Floodproofing" means a combination of structural pro- <br />visions, changes, or adjustments to lands, properties and <br />structures subject to flooding primarily for the reduction <br />or elimination of flood damages to lands, properties, <br />structures, and contents of buildings in a flood hazard area. <br /> <br />(7) "Floodway zone" is the channel of a stream and those portions <br />of the adjoining floodplain which are reasonably required <br />to carry and discharge the floodwaters of an intermediate <br />regional flood. In the context of these regulations, it is <br />the floodplain less the low hazard zone, if any such low <br /> <br />I <br />I <br /> <br />-2- <br />
