<br />. <br />. <br />I <br />. <br />. <br />I <br /> <br />Chapter 5. <br /> <br />FLOODPLAIN REGULATIONS <br /> <br />Article 1. <br /> <br />General and Introductory provisions <br /> <br />5-101 <br /> <br />Purpose and Intent <br /> <br />The purpose and intent of the regulations contained in this <br />chapter shall be to; <br /> <br />. <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />. <br />I <br />I <br />I <br />I <br /> <br />(1) Promote the public health, safety, and general welfare. <br /> <br />(2) Regulate various floodplains constituting natural hazards <br />of state and local interest, the occupation of which is <br />likely to cause the loss of human life and the destruction <br />of property and the imprudent occupation of which will <br />pose a continuing and greater future danger to life and <br />property without proper regulation of their use and <br />occupation. <br /> <br />(3) Facilitate the administration of flood hazard areas by <br />establishing requirements which must be met before devel- <br />opment in such areas is permitted. <br /> <br />(4) Minimize significant hazards to public health and safety <br />or to property in flood hazard areas, to encourage open <br />space activities such as agr~culture, recreation, and <br />mineral extraction, and to ensure that any combination of <br />these activities are conducted in a mutually compatible <br />manner. <br /> <br />(5) Prohibit the building of certain structures in floodway <br />zones of floodplains and to require that structures per- <br />mitted in low hazard zones of floodplains are designed in <br />terms of the availability of flood protection devices, <br />proposed intensity of use, effects on the acceleration of <br />floodwaters, potential significant hazards to public health <br />and safety or to property, and other impacts of such devel- <br />opment on downstream communities such as the creation of <br />obstructions during floods. <br /> <br />(6) Prohibit all activities which, in time of flooding, would <br />create significant hazards to public health and safety or <br />to property and to protect shallow wells, solid waste dis- <br />posal sites, and septic tanks and sewage disposal systems <br />from inundation by floodwaters. <br /> <br />-1- <br />
