<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />to the next higher rating. <br /> <br />(20) "Spotting" means a fire spreading as a result of sparks <br />or embers carried ahead by the wind and starting new fires. <br /> <br />(21) "Timber Density" means the spacing between tree stems in <br />a forest stand. <br /> <br />(22) "Wildfire" means an uncontrolled fire burning in vegeta- <br />tion, structures, or other improvements. <br /> <br />(23) "wildfire Behavior" means the predictable action of a wild- <br />fire under given conditions of fuels, weather and topography. <br /> <br />I <br /> <br />(24) "Wildfire Hazard" means a wildfire phenomenon which is so <br />adverse to past, current, or foreseeable construction or <br />land use as to constitute a significant hazard to public <br />health and safety or to property. <br /> <br />I <br /> <br />4-103 Authority <br /> <br />These regulations are adopted pursuant to inter alia, 24-65. <br />1-101, et seq. and 29-20-101, et seq., C.R.S. 1973. <br /> <br />I <br />I <br />I <br /> <br />4-104 <br /> <br />(1) <br /> <br />(2) <br /> <br />I <br />I <br />I <br /> <br />4-105 <br /> <br />(ll <br /> <br />I <br /> <br />(2 ) <br /> <br />I <br />I <br /> <br />I <br />I <br /> <br />Applicabil ity <br /> <br />These regulations apply to applications for permits to <br />engage in development in all designated or regulated wild- <br />fire hazard areas within this jurisdiction. <br /> <br />Any person seeking to engage in development in any desig- <br />nated or regulated hazard area in this jurisdiction shall <br />obtain a permit pursuant to these regulations before seeking <br />any other permit, rezoning, or other action by the juris- <br />diction. <br /> <br />Nonconforming Uses <br /> <br />The provisions of this chapter shall not apply to or affect <br />any development described in 81-105 of the Administrative <br />Regulations adopted by this jurisdiction, if these regula- <br />tions were adopted pursuant to only 8824-65.1-101, et seq., <br />C.R.S. 1973. -- -- <br /> <br />The provisions of this chapter shall noL apply Lo any non- <br />conforming use existing on the date the area is desiynated <br />or subjected to regulation, provided that, when such a <br />nonconforming use shall be discontinued for six months or <br />more or a nonconforming structure is damaged or destroyed <br />to the extent of at least fifty (50%) percent of the app- <br />raised value, any reuse, reconstruction, or replacement of <br /> <br />-4- <br />
