<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />( 3) <br /> <br />I <br /> <br />I <br /> <br />(4 ) <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(5 ) <br /> <br />posed development or activity may be permitted in any <br />portion of such area, public health, safety and welfare <br />require that the extent of the hazard at the site of <br />the proposed development or activity must be determined. <br /> <br />No person shall engage in any development in any such geo- <br />logic hazard initial control area without a permit. Upon <br />receipt of an application for a permit, the administrator <br />shall recommend to the governing body that it cause a deter- <br />mination to be made as to whether the site for the proposed <br />development is located in a particular geologic hazard area. <br />(Such determination shall be made through a study by a <br />qualified professional geologist or engineer as specified in <br />Section 3-403(4) of these regulations.) The governing body <br />shall promptly take such action with respect to such recom- <br />mendation as may be appropriate and practical. Any appli- <br />cation for a permit to conduct a development in a geologic <br />hazard initial control area shall not be considered complete <br />or be accepted unless and until it is accompanied by the <br />results of any studies needed to determine whether the pro- <br />posed development is located in a particular geologic hazard <br />area. <br /> <br />The necessary studies referred to in subsection 3-202(3) <br />of these regulations may be financed by this jurisdiction, <br />the applicant for a permit, or otherwise. <br /> <br />Upon completion of the study of the area, the administrator <br />shall inform the applicant in writing whether the site of <br />his/her proposed development or activity lies within any of <br />the following: <br /> <br />(a) An avalanche area, in which case further processing of <br />the application shall be governed by section 3-403(1), <br />3-403 (2) (a), and 3-404, below. <br /> <br />(b) A landslide area, in which case further processing of <br />the application shall be governed by section 3-403(1), <br />3-403 (2) (b), and 3-404, below. <br /> <br />(c) A rockfall area, in which case further processing of <br />the application shall be governed by section 3-403(1), <br />3-403(2)(c), and 3-404, below. <br /> <br />(d) A mud flow area, in which case further processing of the <br />application shall be governed by section 3-403(1), <br />3-403 (2) (d), and 3-404, below. <br /> <br />(e) An unstable or potentially unstable slope area, in which <br />case further processing of the application shall be <br />governed by section 3-403 (1), 3-403 (2) (e), and 3-404, <br />below. <br /> <br />-5- <br />
