<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />more or a nonconforming structure is damaged or destroyed <br />to the extent of at least fifty (50) percent of the appraised <br />value, any reuse, reconstruction, or replacement of such <br />structure shall be deemed a new use and shall be subject <br />to the provisions of these regulations. <br /> <br />(3) Uses or adjuncts thereof which are nuisances, or which <br />significantly increase the severity of geologic hazards <br />and create an increasingly severe impact on current or <br />proposed land use in or adjacent to a Designated Geologic <br />Hazard Area, shall not be permitted to continue as non- <br />conforming uses. <br /> <br />I <br /> <br />(4) Any alteration, addition, or repair to any nonconforming <br />structure or significant change in land use permitted pur- <br />suant to Section 3-l05(3) of this Regulation shall be <br />designed to minimize, mitigate or avoid the significant <br />adverse impact of geologic hazards. <br /> <br />I <br />I <br />I <br /> <br />3-106 Relationship of Regulations to Other Requirements <br /> <br />(1) Nothing in these regulations shall be construed as exempting <br />an applicant for a permit from any other requirement of this <br />jurisdiction or other state or federal laws and regulations. <br /> <br />(2) To the extent that the requirements of these regulations <br />differ from any other applicable requirements, the more res- <br />trictive requirements shall apply. <br /> <br />I <br /> <br />Article 2. <br /> <br />I <br />I <br /> <br />Regulation of Geologic Hazatd Areas <br /> <br />3-201 <br /> <br />Permit Required <br /> <br />No person shall engage <br />any permitted or conditional <br />area without a permit. <br /> <br />in any development or activity, including <br />use, in any designated geologic hazard <br /> <br />I <br />I <br /> <br />3-202 Geologic Hazard Initial Control Area <br /> <br />(1) The provisions of this section 3-202 apply to each geologic <br />hazard initial control area shown on the map or maps listed <br />in Article 3 of this Chapter 3. <br /> <br />I <br />I <br /> <br />(2) The governing body of this jurisdiction finds and declares <br />that: <br /> <br />(a) within each such area a geologic hazard exists but its <br />extent has not been determined by thorough, detailed, <br />technical studies. <br /> <br />I <br />I <br /> <br />(b) The hazard is of such significance that before any pro- <br /> <br />-4- <br />
