<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(6) "Landslide" means a mass movement where there is a distinct <br />surface of rupture or zone of weakness which separates the <br />slide material from more stable underlying material. <br /> <br />(7) "Mudflow" means a flowing mass of predominately fine grained <br />earth material possessing a high degree of fluidity during <br />movement. <br /> <br />(8) "Radioactivity" means a condition related to various types <br />of radiation emitted by natural radioactive minerals that <br />occur in natural deposits of rock, soils, and water. <br /> <br />(9) "Rockfall" means the rapid free-falling, bounding, sliding, <br />or rolling of large masses of rock or individual rocks. <br /> <br />I <br /> <br />(10) "Seismic effects" means direct and indirect effects caused <br />by a natural earthquake or a man-made phenomenon. <br /> <br />I <br /> <br />(11) "Unstable or potentially unstable slope" means an area sus- <br />ceptible to a landslide, a mudflow, a rockfall, or acceler- <br />ated creep of slope-forming materials. <br /> <br />I <br />I <br /> <br />3-103 <br /> <br />Authority <br /> <br />These regulations are adopted pursuant to inter alia, 29-20-101, <br />et seq., and 24-65.1-101, et seq., C.R.S. 1973. <br /> <br />3-104 <br /> <br />Applicabili ty <br /> <br />I <br />I <br />I <br /> <br />(1) These regulations apply to applications for permits to <br />engage in development in all designated or regulated geo- <br />logic hazard areas within th~s jurisdiction. <br /> <br />(2) Any person seeking to engage in development in any desig- <br />nated or regulated geologic hazard area in this jurisdiction <br />shall obtain a permit pursuant to these regulations before <br />seeking any other permit, rezoning, or other action by <br />the jurisdiction. <br /> <br />I <br /> <br />3-105 Nonconforming Uses <br /> <br />I <br /> <br />(1) The provisions of this chapter shall not apply to or affect <br />any development described in 61-105 of the Administrative <br />Regulations adopted by this jurisdiction, if these regu- <br />lations were adopted pursuant to only 8824-65.1-101, et. <br />seq., C.R.S. 1973. -- <br /> <br />I <br /> <br />(2) The provisions of this chapter shall not apply to any non- <br />conforming use existing on the date the area is designated <br />or subjected to regulation, provided that, when such a <br />nonconforming use shall be discontinued for six months or <br /> <br />I <br /> <br />I <br />I <br /> <br />-3- <br />
