<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(5) Qualifications of Investigators: <br /> <br />(a) All geologic maps, and reports prepared under this Regu- <br />lation shall be prepared by or under the responsible <br />direction of and signed by a professional geologist as <br />defined by ~~34-l-20l, et seq., C.R.S. 1973. <br /> <br />(b) All engineering work prepared under the requirements of <br />this Regulation shall be prepared by or under the res- <br />ponsible charge of a registered professional engineer <br />as defined in 8812-25-101, et seq., C.R.S. 1973. Such <br />engineer shall also be experienced and competent in the <br />engineering specialty required to meet the objectives of <br />this Regulation. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />2-405 Approval of Permit Application. <br /> <br />(1) The permit authority shall approve an application for a permit <br />to engage in development in a mineral resource area only if <br />all of the following criteria are met: <br /> <br />(a) All of the provisions of the permit application procedure <br />have been complied with; <br /> <br />(b) The proposed development in a mineral resource area can <br />be accommodated within the financial capacity of the area <br />to sustain such growth and development. In measuring <br />financial capacity, the permit authority shall consider, <br />as a minimum, the immediate and long-range services and <br />capital expenditures which will be required both as a <br />result of the proposed development and those employed <br />by or because of the development and the immediate and <br />long-range revenues which will be generated from the <br />development. <br /> <br />(c) The use is an allowable or conditional use under the <br />applicable provisions of 2-203, 2-204, or 2-205 of this <br />chapter. <br /> <br />(d) Structures designed for human occupancy and sites designed <br />for human use shall be constructed so as to prevent <br />danger to human life or property; <br /> <br />(e) Manmade changes shall not initiate or intensify hazardous <br />conditions within a mineral resource area unless appro- <br />priate mitigation techniques are used; <br /> <br />(f) The permit authority has considered recommendations con- <br />cerning the proposed development in the designated <br />mineral resource area which have been received within <br />the time limits specified in 82-401(4) from the Colorado <br /> <br />-15- <br />
