<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Geological Survey, the Colorado Division of Mines, and <br />the Colorado Land Reclamation Board. Additional recom- <br />mendations from the Colorado Oil and Gas Conservation <br />Commission shall also be considered in the same manner <br />by the permit authority for development in designated <br />mineral resource areas which involve oil and gas or <br />geothermal resources. <br /> <br />(g) Nonconflicting open space uses such as agriculture, <br />grazing, greenbelt, and recreation are incorporated <br />into the development plan to the greatest practicable <br />extent; such maximization of open space uses shall be <br />in addition to other required mitigation procedures; <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />(h) The burdens imposed upon local government services and <br />facilities are sufficiently offset by increases in the <br />tax base and local economy or by direct compensation <br />from the developer or other sources in a timely fashion; <br />and <br /> <br />(i) Potential health and safety hazards are reasonably <br />mitigated. <br /> <br />(2) The permit authority may impose such conditions and require <br />such financial guarantees as may be necessary, in its dis- <br />cretion, to meet these standards. <br /> <br />2-406 Permit Denial. <br /> <br />The permit shall be denied if the development does not meet all of <br />the applicable criteria in section 405 of these regulations. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Article 5. <br /> <br />Administration, Enforcement, and Penalties <br /> <br />2-501 <br /> <br />Administration, Enforcement and Penalties. <br /> <br />The provisions of this regulation and any permits issued hereunder <br />shall be administered and enforced according to the provisions of the <br />Administrative Regulations adopted by this jurisdiction. <br /> <br />2-502 <br /> <br />Severability. <br /> <br />If any section, clause, provision, or portion of these regulations <br />should be found to be unconstitutional or otherwise invalid by a court <br />of competent jurisdiction, the remainder of this regulation shall not <br />be affected thereby and is hereby declared to be necessary for the <br />public health, safety, and welfare. <br /> <br />-16- <br />
