<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I 2-205 <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(II) Measures which will offset increased costs of <br />providing any governmental services; <br /> <br />(III) Measures which will insure that air and water <br />pollution resulting from development will meet <br />applicable federal and state laws, rules and <br />regulations; <br /> <br />(IV) Measures which will contain noise and/or obnoxious <br />odors within the development; <br /> <br />(V) Measures which will prevent hazardous traffic pat- <br />terns resulting from development of the site. <br /> <br />(2) All other mineral resource areas covered by this section shall <br />be subject to the restrictions in subsection (1) above if <br />the state Oil and Gas Conservation Commission has previously <br />identified the area for designation. <br /> <br />Uses in Designated Mineral Resource Areas Containing Minerals <br />Other than Sand, Gravel, Quarry Aggregate, Limestone used for <br />Construction Purposes, Oil, Gas, or Geothermal Resources. <br /> <br />(1) Allowable Uses: <br /> <br />(al Exploration and extraction of minerals if the explora- <br />tion and extraction would not cause significant dangers <br />to public health and safety. <br /> <br />(b) Uses which would not interfere with the extraction and <br />exploration of minerals, including the following: <br /> <br />(I) Agricultural uses such as general farming, grazing, <br />truck-farming, forestry, sod farming, and wild crop <br />harvesting; <br /> <br />(II) Public and private recreational uses not requiring <br />permanent structures such as parks, natural swim- <br />ming areas, golf courses, driving ranges, picnic <br />.grounds, wildlife and nature preserves, game farms, <br />shooting preserves, target ranges, trap and skeet <br />ranges and hunting, fishing, skiing and hiking areas; <br /> <br />(III) Public purposes not involving erection of permanent <br />structures which would prevent future extraction <br />of commercial mineral deposits. <br /> <br />(2) Prohibited Uses <br /> <br />(a) Uses which would prevent the future extraction of comm- <br />ercial mineral deposits, unless the permit authority, <br />after weighing sufficient evidence, determines that the <br />value of such use outweighs the economic value of the <br />minerals affected by the use. <br /> <br />-9- <br />
