<br />I <br />I 2-204 <br />I (I) <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Uses in Designated Mineral Resource Areas Containing Oil and <br />Gas or Geothermal Resources. <br /> <br />If the designated mineral resource area contains part or all <br />of another designated area of state interest, or if the pro- <br />posed use is a designated activity of state interest, the <br />following provisions shall apply: <br /> <br />(a) Allowable Uses. <br /> <br />(I) Exploration and extraction of minerals subject to <br />the permit requirements of this chapter; <br /> <br />(II) Agricultural uses such as general farming, grazing, <br />truck-farming, forestry, sod farming, and wild crop <br />harvesting; <br /> <br />(III) Public and private recreational uses not requiring <br />permanent structures such as parks, natural swim- <br />ming areas, golf courses, driving ranges, picnic <br />grounds, wildlife and nature preserves, game farms, <br />shooting preserves, target ranges, trap and skeet <br />ranges and hunting, fishing, skiing and hiking areas. <br /> <br />(IV) Public purposes not involving erection of perma- <br />nent structures which would preclude permanently <br />the extraction of commercial mineral deposits. <br /> <br />(b) Prohibited Uses <br /> <br />(I) Uses which would prevent the future extraction of <br />commercial mineral deposits, unless the permit <br />authority, after weighing sufficient evidence, <br />determines that the value of such use outweighs <br />the economic value of the minerals affected by <br />the use. <br /> <br />(II) Uses which will create a significant impact on the <br />surrounding community, unless the mitigation meas- <br />ures described in subsection (c) below are followed. <br /> <br />(c) Conditional Uses <br /> <br />Land uses which will create a significant impact on the <br />surrounding community and which are generally prohibited <br />in a designated mineral resource, area may be permitted <br />if it is determined that those impacts will be alleviated <br />through the use of documented mitigation techniques. <br />These include but are not limited to: <br /> <br />(I) Measures which will lessen potential dangers to <br />health, safety, economy, or resources to an accep- <br />table level; <br /> <br />-8- <br />
