<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />and nature preserves, game farms, shooting preserves, <br />target ranges, trap and skeet ranges, and hunting, fish- <br />ing, skiing and hiking areas; <br /> <br />(c) Public purposes not involving erection of permanent <br />structures which would preclude permanently the extrac- <br />tion of commercial mineral deposits. <br /> <br />(2) Prohibited Uses <br /> <br />(a) No use shall be allowed which would interfere with the <br />present or futute extraction of such deposits by an <br />operator unless such use was permitted under the zoning <br />governing such land on July 1, 1973. Uses may be alloweq <br />which do not permit erection of permanent structures <br />upon, or otherwise permanently preclude the extraction <br />of commercial mineral deposits by an operator from land <br />subject to said uses. <br /> <br />(b) No use shall be allowed which would create a significant <br />impact on the surrounding community, unless mitigated <br />pursuant to subsection (3) below. <br /> <br />(3) Uses which will create a significant impact on the surrounding <br />community and which are generally prohibited in a designated <br />mineral resource area may be permitted if it is determined <br />that those impacts will be alleviated through the use of <br />documented mitigation techniques. These include but are not <br />limited to: <br /> <br />(a) Measures which will lessen potential dangers to health, <br />safety, economy, or resources to an acceptable level; <br /> <br />(b) Measures which will offset increased costs of providing <br />any governmental services; <br /> <br />(c) Measures which will insure that air and water pollution <br />resulting from development will meet applicable federal <br />and state laws, rules, and regulations; <br /> <br />(d) Measures which will contain noise and/or obnoxious odors <br />within the development; <br /> <br />(e) Measures which will prevent hazardous traffic patterns <br />resulting from development of the site. <br /> <br />(4) To the extent that a proposed use is not covered by sub- <br />sections (1), (2), and (3), above, the provisions of 34- <br />1-301, et seq., C.R.S. 1973 or 34-32-101, et seq., C.R.S. <br />1973, shall apply. -- --- <br /> <br />-7- <br />
