<br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />(3) Any alteration, addition, or repair to any nonconforming <br />structure or significant change in land use permitted pur- <br />suant to Section 2-105(2) of this Regulation shall be de- <br />signed to minimize, mitigate or avoid the significant adverse <br />impact by or to mineral resource utilization. <br /> <br />2-106 Relationship of Regulations to Other Requirements. <br /> <br />(1) Nothing in these regulations shall be construed as exempting <br />an applicant for a permit from any other requirement of this <br />jurisdiction or other state or federal laws and regulations. <br /> <br />(2) To the extent that the requirements of these regulations <br />differ from any other applicable requirements, the more re- <br />strictive requirements shall apply. <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Article 2. <br /> <br />Regulation of Mineral Resource Areas <br /> <br />Permit Required. <br /> <br />No person shall engage in any development or activity, including <br />any allowable or conditional use, in any designated mineral resource <br />area without a permit, except that the extraction of any mineral cov- <br />ered by the provisions of 834-32-101, et seq., C.R.S. 1973 as amended <br />by H.B. 1065 (1976) shall not be required to apply for or obtain a <br />permit under this regulation. <br /> <br />2-201 <br /> <br />2-202 <br /> <br />Mineral Resource Initial Control Area. <br /> <br />(1) The provisions of this section 2-202 apply to each mineral <br />resource initial control area shown on the map or maps listed <br />in Article 3 of this Chapter 2. <br /> <br />(2) The governing body of this jurisdiction finds and declares <br />that: <br /> <br />(a) Within each such area a mineral resource exists but its <br />extent has not been determined by thorough, detailed, <br />technical studies. <br /> <br />(b) The mineral resource may be of such significance that <br />before any proposed development or activity may be per- <br />mitted in any portion of such area, public health, <br />safety and welfare require that the extent of the miner- <br />al resource at the site of the proposed development or <br />activity be determined. <br /> <br />(3) No person shall engage in any development in any such min- <br />eral resource initial control area without a permit. Upon <br />receipt of an application for a permit, the administrator <br />shall recommend to the governing body that it cause a deter- <br />mination to be made as to whether the site for the proposed <br />development is located in a mineral resource area.
