<br />I <br />I <br />I <br />I <br /> <br />water pollution in excess of federal or state standards, a <br />measurable increase in noise or obnoxious odor around resi- <br />dential, or potential residential areas, and contribution <br />to or initiation of hazardous traffic patterns. <br /> <br />(15) "Topsoil" means the layer at the surface of the earth which <br />has been so modified and acted upon by physical, chemical, <br />and biological agents that it will support rooted plants <br />necessary to achieve reclamation goals. <br /> <br />I <br />I <br /> <br />(16) "Underground mining" means mining activity which occurs <br />primarily beneath the surface of the ground. <br /> <br />I <br />I <br /> <br />2-103 Authority. <br /> <br />These regulations are adopted pursuant to inter alia, 29-20-l0l, <br />et seq., and 24-65.1-101, et seq., C.R.S. 1973. <br /> <br />2-104 <br /> <br />Applicabili ty. <br /> <br />I <br />I <br /> <br />(1) These regulations apply to applications for permits to engage <br />in development in all designated or regulated mineral resource <br />areas within this jurisdiction. <br /> <br />(2) Any person seeking to engage in development in any designated <br />or regulated mineral resource area in this jurisdiction shall <br />obtain a permit pursuant to these regulations before seeking <br />any other permit, rezoning, or other action by the juris- <br />diction. <br /> <br />I <br /> <br />(3) These regulations shall not apply to the extraction of any <br />mineral covered by the proviqions of 834-32-101, et seq., <br />C.R.S. 1973. <br /> <br />I <br />I <br /> <br />2-105 Nonconforming Uses. <br /> <br />I <br /> <br />(1) The provisions of this chapter shall not apply to or affect <br />any development described in 81-105 of the Administrative <br />Regulations adopted by this jurisdiction, if these regula- <br />tions were adopted pursuant to only 8824-65.1-101, et seq., <br />C.R.S. 1973. -- --- <br /> <br />I <br /> <br />(2) The provisions of this chapter shall not apply to any non- <br />conforming use existing on the date the area is designated <br />or subjected to regulation, provided that, when such a non- <br />conforming use shall be discontinued for six months or more <br />or a nonconforming structure is damaged or destroyed to the <br />extent of at least fifty (50) percent of the appraised value, <br />any reuse, reconstruction, or replacement of such structure <br />shall be deemed a new use and shall be subject to the pro- <br />visions of these regulations. <br /> <br />I <br /> <br />I <br />I <br />I <br /> <br />-4- <br />
