<br />I <br />I <br />I <br /> <br />conservation commission for designation. <br /> <br />(5) "Mineral Resource Initial Control Area" means an area <br />regulated pursuant to 82-202 of these regulations. <br /> <br />I <br /> <br />(6) "Mining" means the process of removing or extracting <br />minerals and building stone from naturally-occurring veins, <br />deposits, bodies, beds, seams, fields, pools, or other <br />concentrations in the earth's crust. This term also in- <br />cludes the preliminary treatment of such ore or building <br />stone. <br /> <br />I <br />I <br /> <br />(7) "Nonconforming use" means a use in existence at the time <br />of the adoption of these regulations, which use, were it <br />a new use, would be one for which a permit is required <br />under this regulation. <br /> <br />I <br />I <br /> <br />(8) "Open Mining" means the mining of natural mineral deposits <br />by removing any amount of overburden lying above such depo- <br />sits, and mining directly from the deposits thereby exposed. <br />The term includes, but is not limited to, such practices as <br />open cut mining, open pit mining, strip mining, quarrying and <br />dredging. <br /> <br />I <br />I <br />I <br />I <br />I <br /> <br />(9) "Operator" means any person, firm, or corporation engaged in <br />or controlling a mining operation. <br /> <br />(10) "Overburden" means all of the earth and other materials which <br />lie above natural mineral deposits and which are disturbed <br />from their natural state in the process of mining. <br /> <br />(11) "Reclamation" means the rehabilitation of affected land by <br />means of replanting, soil stabilization, water resource pro- <br />tection, and other measures appropriate to the subsequent <br />beneficial use of such mined and reclaimed lands. <br /> <br />I <br /> <br />(12) "Recorded mineral right" means those mineral rights which <br />have been officially recorded or registered with the Colorado <br />Secretary of State or the Clerk and Recorder of the local <br />jurisdiction in which the right is located. <br /> <br />I <br /> <br />(13) "Refuse" means all waste material generated by or directly <br />connected with the mining operations. This includes, but is <br />not limited to, the cleaning, classification, milling, smelt- <br />ing, refining, and preparation of substances mined. <br /> <br />I <br /> <br />(14) "Significant impact" means any material effect on the surround- <br />ing community that potentially endangers health, safety, <br />economy, or resources. It includes, but is not limited to, <br />the imposition of any obstacle to the extraction of a commer- <br />cial mineral deposit, a significant increase in the cost of <br />providing any governmental services, an increase in air and <br /> <br />I <br />I <br />I <br /> <br />-3- <br />
