Dear Mr. Bliss:

Based on the authority conferred to the U.S. Fish and Wildlife Service (Service) by the Endangered
Species Act of 1973, as amended (16 U.S.c. 1531 et llil.), the Service reviewed your letter of
September 18, 1998 regarding the proposed Pawnee Creek Flood Mitigation Project in Logan County,
Colorado near the City of Sterling and potential impacts to federally listed threatened, endangered, and
candidate species. As described in your letter, the proposed project involves the construction of flood
flow routing structures near the town of Atwood, near the Highway 6 and Union Pacific Railroad (UPPR)
bridges over Pawnee Creek, and near Riverside Cemetery.

Based on the project description and habitat information provided in your letter, the Service agrees with
the determination that the proposed project is not likely to adversely effect the whooping crane (Grus
americana), Eskimo curlew (Numenius borealis), black-footed ferret (Mustela nigripes), bald eagle
(Haliaeetus leucocephalus), mountain plover (Charadrius montanus), or swift fox (Vulpes velox).
