4) FEE CONSIDERATIONS - A recommendation will be made that is in compliance with
the standard fee consideration.

5) RECLAMATION OF THE SITE - A reclamation plan shall be developed and provided
to the CWCB for approval prior to the completion of the project.

6) NON-EXCLUSIVE EASEMENT CLAUSE - Language will be stated in the easement
that will reserve the CWCB's right to grant additional easements on the same land
covered by this easement.

THE COLORADO DEPARTMENT OF TRANSPORTATION (CDOT) request - The CDOT
request is for the construction of a segment of the new Santa Fe Drive - Prince Street intersection
on the ewCB Project ROW. This proposed construction is located upstream and downstream of
the existing Prince Street interchange, in the right overbank areas. The preliminary re-alignment
design for Santa Fe Drive project will require approximately 1.0 acre of CWCB lands and a
number of impacts to the site on existing project features. These features are:
. relocation of an in-place statue which was placed by others;
~ relocation of a segment of the bike path which is part of the South Suburban Parks and
Recreation Di,strict's trails system;
. limited access to the outfall works for the City of Littleton's drainage pipe;
. reduced Board access for any future O&M activities that may be required for the project;
and
. loss of 1.0 acre of CWCB lands.

Use for the Requested Area is for the construction of roadway interchange approaches. In
addition, it may be necessary for CDOT to secure additional lands for the relocation of existing
facilities which are presently within the desired parcel.

Conditions for the Easement - The CDOT shall comply with the following conditions:

1) TIME PERIOD - The REAL ESTATE AGREEMENT shall be for a term of _ years
or if fee title a permanent transfer of ownership.

2) PERMITS - The CDOT shall be responsible for securing and monitoring all required
federal, state, and local permits pertaining to Colorado waters and streams..

3) INSURANCE COVERAGE - The CWCB shall be named as an additional insured, and
shall have coverage in the amounts established by the Colorado Governmental hmnunity
Act (part one of article 10 of title 24, lOa C.R.S., as amended.

4) FEE CONSIDERATIONS - A recommendation will be necessary that is in lieu of the
standard fee consideration.

5) RECLAMATION OF THE SITE - A reclamation plan shall be developed and provided
