Action Requested: <br />For the Riverfront Urban Renewal Project - Riverfront Mall Building and the Water Pipeline by <br />Kiewit Construction Company requests, an easement is requested for the approval of an existing <br />use, and construction of a 12-inch water line within the CWCB project right-of way (ROW). For <br />the CDOT request, a real estate agreement is requested which may be in the form of an <br />easement, fee title, or property exchange agreement. It may be necessary to grant the authority <br />to the CWCB Director to negotiate and approve an agreement that is in the best interest of all <br />concerned parties. The Board will be asked to endorse the staff's present position regarding the <br />CWCB-CDOT right-of-way negotiations. <br /> <br />Board staff recommends denial of the Kiewit Construction Company's request for an easement <br />for the following reasons: <br />. Sufficient water should be available from the Englewood treatment plant, which is adjacent to <br />the easement site. <br />. The proposed water line alignment traverses through existing project features; and <br />. The 3,000 foot project will use up all available Board lands for future easements on the left <br />overbank. <br />It does not appear reasonable to the Board staff to use all available left overbank land for one <br />applicant since water can be served to the property from other sources. <br /> <br />r <br />; <br /> <br />RECOMMENDATION <br /> <br />Following a review by the AG's Office and CWCB staff for Agenda Items 7.a.i,ii,&iii <br />requests, a recommendation is as follows: <br /> <br />Approve the easement requests from the City of Littleton, Colorado on behalf of the <br />EchoStar Real Estate Corporation IT or other purchaser of the Riverfront Mall building <br />for an easement for the approval of the existing use and a privacy wall, deny the request <br />of a water line easement from Donald J. Saavedra on behalf of Kiewit Construction <br />Company, and grant the authorization to the CWCB Director to complete negotiations <br />with Colorado Department of Transportation (CDOT) for securing of an real estate <br />agreement that is mutually agreeable to all parties. Grant the authorization to the staff to <br />prepare the necessary easement/agreement contract documents. <br /> <br />4 <br />
