Lile, P.E. <br />Director, eWeB <br /> <br />TO: Colorado Water Conservation Board Members <br /> <br />FROM: Larry Lang <br /> <br />DATE: September 15, 1997 <br /> <br />SUBJECT: Agenda Items 7. a. i, ii, & iii, September 22-23,1997 Board Meeting-- <br />South Platte River Floodplain Project, Right-of-Way Actions <br /> <br />INTRODUCTION <br /> <br />'At the November 6-7, 1995, Board Meeting, approval was given to grant requests for <br />easements in CWCB's right-of-way along the Chatfield Downstream Channel Improvement <br />Project on a case-by-case basis. The Board has received requests from the City of Littleton, <br />Colorado on behalf of EchoStar Real Estate Corporation n or another owner; Kiewit <br />Construction Company in conjunction with the Denver Water Board; and. the Colorado <br />Department of Transportation for permanent easements or real estate agreements. These requests <br />are for the authorization of an existing use, construction of a water supply line, recreational <br />. facilities or a segment of roadway across the CWCB's project right-of-way (ROW). <br /> <br />DISCUSSION <br /> <br />Item 7.a.i <br /> <br />The City of Littleton, Colorado, on behalf of EchoStar Real Estate Corporation, requests an <br />approval of an easement for an existing development activity. The development activity is known <br />as the Riverfront Urban Renewal Project at Bowles Avenue and Santa Fe Drive. It appears that <br />an encroachment occurred on the CWCB right-of-way in 1985 (See Exhibit A). The City's <br />request letter is attached as Exhibit B. <br /> <br />Use for the Requested Area - If the easement for the existing encroachment is granted, the use <br />of the encroachment would remain at its present use. The existing use consists of a patio and <br />related landscaping activities, including a four foot (4') privacy wall along the western edge of <br />the patio. <br /> <br />1 <br />
