<br />.~ J <br /> <br />Whenever it shall become necessary, in the construction, <br /> <br />maintenance or use of the Imorovements to install, relocate or <br /> <br />make any chanaes or alterations in fences, sianal, power or <br /> <br />communication pole and wire lines, drainage or any other <br />facilities of the Santa Pe upon the Premises or any other pro- <br /> <br />perty of the Santa Fe, such installations, changes or alterations <br /> <br />shall be made by the Santa Fe at the sole cost and expense of the <br />Town, and cost thereof shall be paid by the Town within <br />twenty. days after rendition of bills therefor. <br />Section 2.3. LIABILITY, The Town shall indemnify and <br /> <br />. <br /> <br />save harmless the Santa Fe against all claims, demands, actions <br /> <br /> <br />or causes of action, arisin9 or growing out of the loss of or <br /> <br />damage to property or injury to or' death of persons, resulting <br /> <br />in any manner.from the construction, maintenance, lack of <br /> <br />maintenance, use, state of repair or presence of the Improve- <br /> <br />ments upon the Premises, and will, promptly pay to the Santa Fe <br />the full amount of any lQSS or damage which the Santa Fe may <br /> <br />sustain, incur or become liable for, and all sums which Santa Fe <br /> <br />may payor be compelled to pay in settlement of any claims on <br /> <br />account thereof. <br /> <br />Section 2.4, LIENS, The Town shall promptly pay and dis- <br /> <br />charge any and all liens arising out of any construction or <br /> <br />other work performed on the Premises by its contractor and/or <br /> <br />contractors or under its direction, and the Santa Fe is hereby <br /> <br />authorized to post any notices or take any other action upon or <br /> <br />with respect to the Premises, that is or may be permitted by <br /> <br />law, to prevent the attachment of any such liens to the Premises; <br /> <br />provided, however, that failure of the Santa Fe to take such <br /> <br />- 4 - <br />
