action shall not relieve the To~m of any Obligation or liab-
ility under this agreement.

ARTICLE III

Section 3.1. EVICTION. In case of the eviction of the

Town by any other party or parties, owning or claiming title

to the whole or any part of the Prem"ses, the Santa Fe shall
not be liable to the Town for any damages of any nature

whats~ever on account thereof.

Section 3.2. REVERSION UPON ABANDONMENT. This instrument

9hall not be construed as granting the Town any estate, title
or interest in or to the Premises or any part thereof, and if at

any time the use of the Premises for the purposes herein des-

cribed should be abandoned by the TO'l:n the use and occupanc}' of
the Premises shall immediately revert and revest in the Santa

Fe, its successors or assigns.

Section ~.3. NEGATION OF WARRANTY. This agreement is made
without warrbnty of any kind, expressed or implied, and no
covenant 6f warranty shall be implied from the use of any word

or words herein contained.

Section 3.4. SUCCESSORf. AND ASSIGNS. All the covenants and

provisions of this agreement shall be binding upon and inure to the
benefit of the successors and assigns of the parties hereto to

the same extent and effect as the same are binding upon and inure

to the benefit of the parties hereto.

Section 3,'5. SECTION HEADINGS. All section headings are

inserted for convenience only and shall not affect any construction

or interpretation of this agreement.
