Section 1.2. SANTA FE RESERVATIONS. Santa Fe hereby

reserves unto itself and others, who have obtained or may obtain

perm:.ssion or authority from Santa Fe to so do, the right

(a) to operate, maintain, renew and relocate any and
all existing tracks, embankments, bridges, fences,
drainage ditches, pipe, power, communication,
signal and other wire lines and appurtenances, and,
other facilities, upon, over or under the surface
of the Premises; and

(b) from time to time to construct, operate, maintain,
renew and relocate upon, over or under the surface
of the Premises such additional facilities as will
not unreasonably interfere with the use of the
Premises for said Improvements.

ARTICLE II

FOR AND IN CONSIDERATION OF the conveyance, covenants and

agreements of Santa Fe, as hereincbove set forth, the Town

agrees as follows:

Section 2.1. CHARAC~ER OF USE. That it will use the

Premises solely and only for the. uses and purposes specified in
Section 1.1 hereof.

Section 2.2. CONSTRUCTION AND MAINTENANCE. That it will,

at its sole cost and expense, constr~ct or cause to be constructed,

maintain and use the Improvements and appurtenances in such a

manner and of such material that they will not at any time be a

source of danger to or interference with the present or future

tracks, roadbed and adjacent property of the Santa Fe or the

safe operation of its railroad. AJ,l work in connection with the

Imrrovements shall be performed in accordance with plans which

shall be submitted to and approved by the Santa Fe.
