<br />with the Federal legislation authorizing such Project, the Town shall, in <br /> <br />consideration of the Government commencing the construction thereof, fulfill <br /> <br />the requirements of non-Federal cooperation specified in such legislation, <br /> <br />to wit: <br /> <br />a. The Town promises and guarantees the Government that it will <br /> <br /> <br />furnish without cost to the Government all lands, easements, rights-of-way and <br /> <br /> <br />spoil disposal areas necessa~ for construction, maintenance and operation of <br /> <br />. <br /> <br />the Project. <br /> <br /> <br />b. The Town agrees to bear the costs of all alterations and reloca- <br /> <br /> <br />tions of utilities (except utilities integral to Project structures), roads, <br /> <br /> <br />bridges, cemetaries and any other community services, except railroads, that <br /> <br />are required for construction of the Project. <br /> <br /> <br />c. The Town promises and guarantees to hold and save the United <br /> <br /> <br />States free and harmless from damages due to construction of the Project, except <br /> <br /> <br />damages due to the fault or negligence of'the United States or its contractors. <br /> <br /> <br />d. The Town agrees to maintain and operate the Project in accordance <br /> <br /> <br />with regulations prescribed by the Secretary of the Army. <br /> <br /> <br />e. The Town agrees to prevent any encroachment that would prevent <br /> <br />or restrict the flows in the improved channel and capacity of the ponding areas. <br /> <br /> <br />f. The Town agrees to assume full responsibility for all Project <br /> <br /> <br />costs in excess of the Federal cost limitation of $1,000,000.00. <br /> <br />g. The Town agrees to, at least annually, publicize and notify all <br /> <br /> <br />interested parties that some flooding will continue to occur due to flows <br /> <br /> <br />greater than design magnitude. <br /> <br />h. The Town agrees to adopt such flood plain regulations necessary <br /> <br /> <br />to insure compatibility between future development and the degree of flood <br /> <br /> <br />protection afforded to the Project area. <br /> <br /> <br />i. The Town agrees to publicize the special flood hazard information <br /> <br /> <br />contained in Appendix 3 of the Detailed Project Report for Flood Control at <br /> <br /> <br />Granada, Colorado, and make it readily available to all interested parties. <br /> <br /> <br />j. The Town agrees to acquire a flowage easement which will allow <br /> <br /> <br />for flooding of approximately 100 acres of agricultural land in the area across <br /> <br /> <br />Wolf Creek from the Town of Granada. <br /> <br />2 <br />
