<br />k. Upon request by the Government, the Town will furnish evidence of <br /> <br />title reflecting a sufficient property interest in the flood control works to <br /> <br />protect the Government, and will furnish a certificate from its attorney that <br /> <br />the property interests held by the Town are sufficient to protect the Government <br /> <br /> <br />in entering upon and constructing such Project. <br /> <br /> <br />2. The Town hereby gives the Government a right to enter, at reason- <br /> <br /> <br />Bbl, times and in a reasonable manner, upon lands which the Town owns or controls, <br /> <br />for access to the Project for the purpose of inspection, and for the purpose of <br /> <br /> <br />completing, repairing and maintaining the Project if such inspection shows that <br /> <br /> <br />the Town, for any reason, is failing to repair and maintain the Project in <br /> <br /> <br />accordance with the assurances hereunder and has persisted in such failure <br /> <br /> <br />after a reasonable notice in writing by the Government delivered to the Mayor <br /> <br />or Town Clerk. No repair and maintenance by the Government in such event shall <br /> <br /> <br />operate to relieve the Town of responsibility to meet its obligations as set <br /> <br />forth in paragraph 1 of this Agreement, or to preclude the Government from <br /> <br /> <br />pursuing any other remedy at law or equity. <br /> <br />3. The Town promises to comply with the Relocation Assistance Act; <br /> <br /> <br />and without limiting the generality of the foregoing, promises: <br /> <br /> <br />a. Payments and services required by Sections 210 and 305 of the <br /> <br /> <br />Act, as implemented by regulations prescribed by or under the authority of the <br /> <br /> <br />Secretary of the Ar~, will be provided. <br /> <br />b. Within a reasonable time prior to displacement, decent, safe and <br /> <br /> <br />sanitary dwellings will be made available to displaced persons in accordance <br /> <br /> <br />with standards established by regulations prescribed by or under the authority <br /> <br /> <br />of the Secretary of the A~. <br /> <br />c. In acquiring real property, the Town will be guided to the <br /> <br /> <br />greatest extent practicable by the land acquisition pOlicies in Sections 301 <br /> <br /> <br />and 302 of the Act; and property owners will be paid or reimbursed for necessary <br /> <br /> <br />expenses as specified in Sections 303 and 304 of the Act; all as implemented <br /> <br /> <br />by regulations prescribed by or under the authority of the Secretary of the Army. <br /> <br /> <br />d. The Town will furnish an annual report on its activities with <br /> <br /> <br />respect to the programs and policies established or authorized by the Act to <br /> <br /> <br />f~cilitate compliance with the reporting requirement contained in Section 214 <br /> <br /> <br />thereof. <br /> <br />3 <br />
