<br />Post-Firm Construction: is construction or substantial
<br />improvement, which started on or whichever, is later.
<br />
<br />Pre-Firm Construction: is construction or substantial
<br />improvement which started on or before December 31,
<br />1974, or before the effective date of the inrtial Flood
<br />Insurance Rate Map (FIRM) of the community, which-
<br />ever is later.
<br />
<br />Principally Above Ground: shall mean that at least 51
<br />percent of the actual cash value of the structure is
<br />above ground,
<br />
<br />Private Nonprofit Facility: Any private nonprdrt edu-
<br />cational, utility, emergency, medical, or custodial Care
<br />facility for the aged or disabled, and other fac:ilrty provid-
<br />ing essential govemmental type services to the general
<br />public, and such facilrties on Indian reservations, Fur-
<br />ther definition is as follows:
<br />
<br />a. Educational Facility: Classrooms plus related sup-
<br />plies, equipmen~ machinery, and utilrties of an edu-
<br />cational instrtution necessary or appropriate for in-
<br />structional, administratwe, and support purposes,
<br />but does not include buildings, structures and re-
<br />lated rtems used primarily for religious purposes or
<br />instruction
<br />
<br />b. Utility: Buildings, structures, or systems d energy,
<br />communication, water supply, sewage collection and
<br />treatment, or other similar public service facilrties.
<br />
<br />c. Emergency Facfllty: Those buildings, structures,
<br />equipment, or systems used to provide emergency
<br />services, such as fire protection, ambulance, or res-
<br />cue, to the general public, including the administra-
<br />tion and support facilrties essential to the operation
<br />of such emergency facilities even ~ not contiguous,
<br />
<br />d. Medical Facility: Any hosprtal, outpatient facility, a
<br />rehabilitation facility, or facility for long term care as
<br />such terms are defined in section 645 d the Public
<br />Health Service Act (42 U,S,C. 2910) and any similar
<br />facilrty olfering diagnosis of or treatment d mental or
<br />physical injury or disease, including the administra-
<br />twe and support facilities essential to the operation
<br />of such medical facilrties even ~ not contiguous,
<br />
<br />e. Custodial Care Facility: Those buildings, struc-
<br />tures, or systems including those for essential ad-
<br />ministration and support, which are used to provide
<br />instrtutional care for persons who require close Su-
<br />pervision and some physical constraints on their
<br />daily activities for their se~-protection, but do not
<br />require day-to-day medical care,
<br />
<br />f. Other Essential Governmental ServIces Fae/lf-
<br />ties: Facilrties such as museums, zoos, communrty
<br />centers, libraries, homeless she~ers, senior citizen
<br />centers, rehabilitation facilrties, she~er worKshops,
<br />and facilities which provide hea~h and safety ser-
<br />vices of a govemmental nature, All such facilities
<br />
<br />must be open to the general public,
<br />
<br />Prfvate Nonprofit Organ/zatfon: Any non-
<br />governmental agency or entity that currently has:
<br />
<br />a. An effective ruling letter from the U.S, Internal Reve-
<br />nue Service, granting tax exemption under section
<br />501(c), (d), or (e) of the Internal Revenue Code of
<br />1954, or
<br />
<br />b. Satisfactory evidence from the State that the non-
<br />revenue producing organization or entrty is a non-
<br />profit one organized or doing business under State
<br />law,
<br />
<br />Probation: is the means of formally not~ying participat-
<br />ing communities of violations and deficiencies in the
<br />administration and enforcement d the local floodplain
<br />management regulations, A communrty is placed on
<br />probation for one year (may be extended) during which
<br />time a surcharge is applied to all NFIP policies issued
<br />on or after the Probation Surcharge effective date, Pro-
<br />bation is terminated ~ deficiencies are corrected, If a
<br />community does not take remedial or corrective meas-
<br />ures while on probation, rt can be suspended,
<br />
<br />Project: All work performed at a single srte or mu~iple
<br />srtes as described on a project summary.
<br />
<br />Public Assistance: Federal financial assistance pro-
<br />vided through the Public Assistance Grant Program
<br />(PAGP) to state and local governments or to eligible
<br />private nonprofrt organizations for disaster-related re-
<br />quirements,
<br />
<br />Public Assistance Permanent Worll: The restorative
<br />work that must be done, through repairs or replace-
<br />ment, to restore an eligible facility on the basis of rts
<br />pre-disaster design and in conformrty with current appli-
<br />cable codes, specifications, and standards,
<br />
<br />PublIc Entity: An organization formed for a public pur-
<br />pose whose direction and funding are provided by one
<br />or more polrtical subdwisions of the state,
<br />
<br />Reach: a continuous segment of a watercourse,
<br />
<br />Recreational VehIcle: shall mean a vehicle which is (i)
<br />built on a single chassis; (ii) 400 square feet or less
<br />when measured at the largest horizontal projections;
<br />(iii) designed to be se~-propelled or permanently towed
<br />by a light duty truck; and (iv) designed primarily not for
<br />use as a permanent dwelling but as temporary living
<br />quarters for recreational, camping, travel, or seasonal
<br />use.
<br />
<br />Regular Program (NFIP): is the phase of a commu-
<br />nity's participation in the NFIP where more comprehen-
<br />sive floodplain management requirements are imposed
<br />and higher amounts of insurance are available based
<br />upon risk zones and elevations determined in a flood
<br />insurance study, The Flood Insurance Rate Map is the
<br />map used in this phase 01 the NFIP,
<br />
<br />Regulatory Flood Elevation: in Colorado means the
<br />Base Flood Elevation plus one foot of freeboard which
<br />is required to meet the Minimum Standards for Flood-
<br />plain Management in the State d Colorado.
