The Chicago-Rock Island Railroad should replace the two <br />temporary culverts with a structure or structures which will <br />pass the 100-year flood without raising the water surface <br />elevation above the existing channel banks of the tributaries <br />(4-5 foet). The new structure could take the form of multiple <br />culverts. box culverts. a new trestle or other configuration. <br /> <br />I <br />I <br /> <br />2. If the railroad does not voluntarily replace the <br />culverts. the Town of Limon's attorney should actively" seek <br />through the courts the required replacement. There is a similar <br />case in Wyoming where a group of 25 residents who were flooded <br />by the railroads replacement of a bridge by culverts. The 25 <br />residents won their case in "Federal Court". This case <br />incidentaly was never appealed (see Exhibit A and B). <br /> <br />I <br /> <br />4. We favor Alternative I-D using 7 ft. x 7 ft. Box <br />Culverts and two tracks instead of 4 tracks due to the lesser <br />cost. A bargaining position might be for the Town to supply <br />the box culverts and the railroad install them. This would <br />bypass all of the problems associated with engineering. <br />easements and train delays. <br /> <br />I <br /> <br />5. The Town of Limon should clear the channel of <br />obstructions upstream and downstream from the railroad <br />embankment. including vegetation and old junk. in order to <br />improve passage of flood flows.
