TERMS AND CONDITIONS (conL) <br /> <br />"BASIC STANDARDS APPLICABLE TO SURFACE WATERS OF THE STATE - All surface waters of the State <br />are subject to the following basic standards; however, discharge of substances tegulated by permits which are within <br />those permit limitations shall not be a basis for enforcement proceedings under these basic standards: <br /> <br />(I) Except where authorized by permits, BMP's Ot plans of operation approved by the Division, state surface <br />waters shall be ftee from substances attributable to human-caused point source or nonpoint source discharge in <br />amounts, concentrations or combinations: <br /> <br />(a) which can settle to form bottom deposits detrimental to the beneficial uses. Depositions are stream <br />bottom buildup of materials which include but are not limited to anaerobic sludges, mine slurry or <br />tailings, silt, Ot mud; or <br />(b) which form floating debris, scum, or othet surface matetials sufficient to harm existing beneficial uses; <br />or <br />(c) which produce colot, odor, or other conditions in such a degree as to create a nuisance or harm existing <br />beneficial uses or impart any undesirable taste to significant edible aquatic species Ot to the watet; Ot <br />(d) which are harmful to the beneficial uses or toxic to humans, animals, plants, or aquatic life; or <br />(e) which produce a predominance of undesirable aquatic life; or <br />(f) which cause a film on the surface or produce a deposit on shorelines." <br /> <br />2. Specific Limitations <br /> <br />The following limitations shall apply to all discharges coveted by this permit: <br /> <br />a) Concrete wash watet shall not be discharged to state waters or to storm sewer systems. <br /> <br />b) Bulk storage structures for petroleum products and other chemicals shall have adequate protection so as to <br />contain all spills and prevent any spilled material from entering State waters. <br /> <br />c) No chemicals are to be added to the discharge unless permission for the use of a specific chemical is granted <br />by the Division. In granting the use of such chemicals, special conditions and monitoting may be addressed <br />by separate letter. <br /> <br />d) The Division reserves the right to require sampling and testing, on a case-by-case basis, in the event that there <br />is reason to suspect that compliance with the SWMP is a problem, or to measure the effectiveness of the <br />BMPs in temoving pollutants in the effluent. Such monitoring may include Whole Effluent Toxicity testing. <br /> <br />e) All wastes composed of building materials must be removed from the site for disposal in licensed disposal <br />facilities. No building material wastes Ot unused building materials shall be buried, dumped, or discharged at <br />the site. <br /> <br />f) Off-site vehicle tracking of sediments shall be minimized. <br /> <br />g) All dischargers must comply with the lawful requirements of municipalities, counties, drainage districts and <br />other local agencies regarding any discharges of stormwater to storm drain systems or other water courses <br />under their jurisdiction, including applicable requirements in municipal stormwater management programs <br />developed to comply with CDPS permits. Dischargers must comply with local stormwater management <br />requirements, policies or guidelines including erosion and sediment control. <br /> <br />3. Prohibition of Non-stonnwater Dischart!es <br /> <br />aJ Except as provided in paragtaph b, below, all discharges covered by this permit shall be composed entirely <br />of stonnwater. Discharges of material othet than stormwater must be addressed in a separate CDPS permit <br />issued for that discharge. <br />
