<br />WHEREAS, the drainage area for Unnamed Tributary to Sand Arroyo is less than the <br />lower limit, one-half (0.5) square mile, for the use of the U.S. Geological Survey publication, <br />Techniques For Estimating Regional Flood Characteristics of Small Rural Watersheds in the <br />Plains Region of Eastern Colorado; and <br /> <br />WHEREAS, Unnamed Tributary to Sand Arroyo thereby constitutes a local drainage area; <br /> <br />and <br /> <br />WHEREAS, a procedure for determining hydrology information for approximate <br />floodplains of local drainage areas has not been established; and <br /> <br />WHEREAS, the local drainage areas may be designated as approximate floodplain <br />information without a procedure for estimating 100-year peak flows as long as the local <br />government understands and agrees that a detailed hydrologic and hydraulic study is required <br />prior to any floodplain development; and <br /> <br />WHEREAS, said drainage area should be reviewed for flood hazards on a case-by-case <br />basis; and <br /> <br />WHEREAS, the review of said local drainage area on a case-by-case basis is consistent <br />with the Guidelines for Determining 100- Year Flood Flows for Approximate Floodplains; and <br /> <br />WHEREAS, the Colorado Water Conservation Board is taking this action under provisions <br />set forth in 2 CCR 408-1 Rule 9.D.2. (Board Initiative) and Walsh has been notified and their <br />comments have been considered in this resolution; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, Walsh has been notified that local drainage areas may be designated as <br />approximate floodplain information without a procedure for estimating 100-year peak flows, as <br />long as the local government understands and agrees that a detailed hydrologic and hydraulic <br />study is required prior to any floodplain development; and <br /> <br />2 <br />
