<br />includes approximate floodplain information, which was supported by a detailed hydrologic <br />analysis, which was previously correctly mapped and designated and approved by Resolution No. <br />96-416 and subsequently incorrectly mapped by the Federal Emergency Management Agency on <br />September 30, 1992, which information has now been mapped correctly to eliminate the error of <br />September 30, 1992, for the stream reach listed in Table I, attached hereto and by this reference <br />incorporated herein: <br /> <br />TABLEt <br /> <br />Approximate Information Which Corrects A Previous FEMA Mappinl! Error <br /> <br />Fishers Canyon extending the corporate limit of the City of Colorado Springs just upstream of the crossing of <br />Loomis Avenue, as it was on November 2, .1994, upstream to the crossing of Meadow Drive <br /> <br />WHEREAS, the Board is taking this action under the provisions of Rule 9.0.2. of the <br />Board's "Rules and Regulations for the Designation and Approval of Floodplains and of Storm <br />or Floodwater Runoff Channels in Colorado" (2 CCR 408-1), (Board Initiative), and the City of <br />Colorado Springs and the El Paso Regional Building Department have been notified and their <br />comments have been considered in this resolution; and <br /> <br />WHEREAS, the City of Colorado Springs, Colorado, has sent a letter requesting the <br />Colorado Water Conservation to designate and approve the floodplains set forth in the aforesaid <br />new report which was dated after the deadline of 30 days prior to this Board meeting; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater runoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or <br />basins and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />WHEREAS, the information in said new report for the study reach listed in Table 1 meets <br />all of the requirements for approximate information listed under the Board's "Rules and <br />Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater Runoff <br />Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the information in said new report for the study reach listed in Table I is <br />consistent with the approximate floodplain information for said stream reach previously <br />designated by Resolution No. 96-416 and merely corrects a mapping error made by the Federal <br />Emergency Management Agency on September 30, 1992; <br /> <br />5 <br />
