<br />M. Montana reports that the fees may be set by administrative rule. <br /> <br />N. Nebraska requires a fee when Engineering design and specifications are <br />submitted for reviewal. <br /> <br />O. New Mexico requires a fill ing fee of $10 plus $1 per thousand of <br />estimated construction cost of the dam. <br /> <br />P. North Dakota requires a fee for a water permit when in excess of' 12 <br />1/2 acre-feet, but not for construction permit. <br /> <br />Q. Pennsylvania requires proof of financial responsibility to assure <br />continued maintenance after completion of construction. <br /> <br />R. Vermont indicates that this is an option of the owner. <br /> <br />S. West Virginia reports its maximum fee is $25. <br /> <br />8. Require an emergency action preparedness plan for each dam or reservoir. <br /> <br />28 states (56%) currently perform this function <br /> <br />Comments: <br /> <br />A. Arizona's authority is currently exercised on High Hazard and some <br />Significant Hazard potential dams. <br /> <br />B. Arkansas intends to revise its rules and regulations to require <br />emergency action plans as may be deemed necessary. <br /> <br />C. CaUf'ornia's office of Emergency Services has the responsibility for <br />working with owners and local law enforcement agencies on these plans. <br /> <br />D. Colorado requires plans for High Hazard dams only. <br /> <br />E. Connecticut requires emergency action plans only for High and <br />Significant Hazard potential dams. <br /> <br />F. Florida reports that statutory authority allows emergency action. <br /> <br />G. Georgia reports that the Safe Dams Program is beginning to develop <br />flood maps for dam failures for local EMA groups to develop emergency <br />action plans. <br /> <br />H. Iowa has statutory authority to implement such a plan, however, has <br />only been required in one instance. <br /> <br />I. Kansas reports that plans are required for dams classified as High <br />Hazard in the Corps' National Dam Inspection Program. <br /> <br />J. Kentucky is beginning preparation of emergency preparedness plans for <br />state-owned dams. <br /> <br />-22. <br />
