<br />L. New York supplied a copy of proposed rules and regulations. Upon <br />approval by the State Environmental Board on October 21, 1985, they <br />will become official. <br /> <br />M. North Dakota has the authority to do so but have not as of this date. <br /> <br />N. Rhode Island notes that it has requested this authority for the last <br />two years, without success. <br /> <br />O. South Dakota has a pending proposal for rules and regulations; has <br />presented them to 1984 legislative session and was turned down. <br /> <br />P. Washington has some rules. Intends to promulgate new regulations as <br />program evolves. <br /> <br />7. Require the establishment of' a bond or f'ee as part of' the construction <br />permit application. <br /> <br />22 states (44~) currently perform this function <br /> <br />Comments: <br /> <br />A. Alaska requires a fee based on size of impoundment. <br /> <br />B. Calif'ornia requires a fee. <br /> <br />C. Colorado requires a fee. <br /> <br />k <br /> <br />D. Florida requires this by statutory authority, but rules and <br />regulations are not in effect. <br /> <br />E. Idaho requires a bond to decommission a site for abandoning a tailings <br />structure. <br /> <br />F. Illinois reports that this is optional at its discretion. <br /> <br />G. Indiana requires a $50 application fee for processing a permit <br />application. <br /> <br />H. Kentucky is proposing a change to the General Assembly that would <br />require bonding of High Hazard dams. <br /> <br />I. Maryland does not require any (bond of fee) from state agencies or <br />local governments. <br /> <br />J. Michigan's permit fee is based on the (maximum water) head of the <br />proposed structure. <br /> <br />K. Minnesota requires construction inspection fees for privately-owned <br />dams. <br /> <br />L. Mississippi requires only an application for written authorization for <br />construction of new dams or repair modifications of existing dams. <br /> <br />-21- <br />
