<br />F. Montana exempts any High Hazard dams that were inspected by the Corps <br />under P.L. 92-367 until October 1, 1990; also Federal-owned or _ <br />licensed and inspected dams, FERC controlled, or having a Montana <br />metal mine reclamation operating permit. ' <br /> <br />G. North Dakota has done so in the past and will continue. <br /> <br />H. Vermont refers to its Dam Statute, 10VSA43, Section 1095. <br /> <br />I. Washington can issue regulatory orders or initiate abatement actions. <br /> <br />6. Adopt rules and regulations f'or the purpose of carrying out the <br />provisions of' your State's dam safety program. <br /> <br />41 states (82~) currently perform this function <br /> <br />Comments: <br /> <br />A. Connecticut has adopted regulations <br />regulations for periodic inspections and <br />permit application submittals. <br /> <br />for registration, proposed <br />are developing guidelines for <br /> <br />B. Delaware has no State's Dam Safety program. <br /> <br />C. Florida does not have rules and regulations but has authority to <br />establish. <br /> <br />D. Kansas' rules and regulations, with renslOns, have been adopted by <br />the Chief Engineer relating to administrative requirements and <br />criteria for the design of earthen dams. <br /> <br />E. Maine reports that this has not been done yet. <br /> <br />F. Massachusetts' current legislation allows for this, but new <br />legislation is being used to promulgate its rules and regulations. <br /> <br />G. Mississippi is still in the process of getting its rules and <br />regulations ready for approval. <br /> <br />H. Missouri's revised Rules and Regulations in effect January 1, 1985. <br /> <br />1. Montana's rules and regulations exempt any High Hazard dams that were <br />inspected by the Corps under P.L. 992-367 until October 1, 1990. Also <br />exempted are Federal-owned or -licensed and inspected dams, FERC <br />controlled, or having a Montana metal mine reclamation operating <br />permit. <br /> <br />J. Nevada reports that it has not updated its rules and regulations since <br />1971. <br /> <br />K. New Mexico refers to its N.M.
