<br />P. Rhode Island notes that approximately <br />inspected either annually, biennially, <br />size and/or potential downstream hazard. <br /> <br />140 of its largest dams are <br />or triennially, depending on <br /> <br />Q. South Dakota reports "Usually not a scheduled inspection". <br /> <br />R. Tennessee reports that in the past, very few inspections have been <br />done. Presently, their existing dams program is being organized to <br />inspect each dam every five years. <br /> <br />S. Utah inspects High Hazard dams every year, Moderate Hazard every other <br />year, and Low Hazard every five years. <br /> <br />T. Vermont refers to its Dam Statute, 10VSA43, Section 1105, which calls <br />for periodic inspections, but no inspection frequency is specified. <br /> <br />U. Virginia's inspections are required by the owner's engineer at 2- 3-, <br />or 5-year intervals, depending on Hazard Class. <br /> <br />V. Washington has the authority but not the capability to inspect all <br />dams every five years. Periodic inspection program is being started. <br /> <br />I <br />L <br />I <br />I, <br /> <br />W. West Virginia's statute s imply requires inspections; the regulations <br />require inspections annually or once every two years depending on the <br />situation. <br /> <br />X. Wisconsin requires inspections at least once every 10 years. <br /> <br />5. Issue notices when appropriate to require the owner of the dam and <br />reservoir to pert'orm necessary maintenance or remedial work, revise <br />operating procedures or take other actions including breaching ot' the dam <br />when deemed necessary. <br /> <br />47 states (94%) currently perform this function <br /> <br />Comments: <br /> <br />A. Arizona's legislation provides authority to make emergency repairs or <br />to breach a dam, but funding capabilities are limited. <br /> <br />B. Georgia requires the owner to maintain the dam in compliance with the <br />operation permit. <br /> <br />C. Kansas' Chief Engineer has statute authority to require appropriate <br />action to be taken to protect the public safety. <br /> <br />D. Michigan reports that when its DNR believes a dam is in a hazardous <br />condition, the statutory authority requires the owner to hire a <br />licensed engineer to conduct an independent inspection report. If <br />this report also concludes that the dam is in a hazardous condition, <br />DNR can then order repair or removal of the dam. <br /> <br />E. Missouri's revised rules and regulations include Emergency Actions and <br />Enforcement procedures. <br /> <br />-19- <br />
