<br />WHEREAS the City of YlUTIa completed new drainage projects in 1985 and 1994 that <br />reduced nuisance flooding caused by stormwater nmoff within portions of the community, and <br />these improvements are discussed but not analyzed in said new report; and <br /> <br />WHEREAS, said new report is intended for informational pwposes only for the City of <br />Yuma and is not intended to be used for National Flood Insurance Program pwposes; and <br /> <br />DESIGNATION ACTION <br />WHEREAS, the Colorado Water Conservation Board is taking this designation action under <br />the provisions set forth in 2 CCR 408-1, Rule 9.D.2 (Board Initiative) and the City of YlUTIa has <br />been notified ofthis action; and <br /> <br />WHEREAS, a meeting was held between CWCB staff and City of YlUTIa staff to discuss <br />floodplain issues and the floodplain designation process, and the City verbally agreed with the <br />CWCB's rescission of said FHBM dated April 23, 1976 and designation of said new FIR dated May <br />1999 and; and <br /> <br />c.R.S AUTHORITY <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater nmoff channel or basin only after designation and approval by the Colorado <br />Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater nmoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br />WHEREAS, the 100-year peak flow values for the tributaries in Yuma have been computed <br />by Hydro-Triad, Ltd. using acceptable hydrologic techniques approved under the Board's "Rules <br />and Regulations for the Designation and Approval of Floodplains and of Storm or Floodwater <br />Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, hydraulic determinations and floodplain delineations for the tributaries in <br />Yuma have been prepared by Hydro-Triad, Ltd. using approximate techniques approved under the <br />Board's "Rules and Regulations for the Designation and Approval of Floodplains and of Storm or <br />Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the approximate floodplain information in said Phase A report dated <br />November 1976 was incorporated into said new report dated May 1999 for tributaries in the City of <br />Yuma and meets the requirements for approximate floodplain information as listed in the Board's <br />"Rules and Regulations for the Designation and Approval of Floodplains and of Storm or <br />Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />2 <br />
