<br />... Floodplain Regulations <br /> <br />Floodplain regulations can be accomplished through community <br />zoning or a permit system. Following the disastrous floods of <br />1965, the 1966 Colorado General Assembly passed House Bill 1007 <br />which authority Cities/towns and county governments to regulate <br />floodplain activities through the zoning statutes. This <br />authority is contingent upon the Colorado Water Conservation <br />Board approving and designating the base data and flood <br />outlines. The permit authority to local governments was granted <br />through the enactment of House Bill 1041 in 1974. <br /> <br />Detention of Increased Flows From Development <br /> <br />Due to rapid development, in many Colorado regions, <br />downstream land owners often question if historical runoff rates <br />have increased because of changes in upper basin land uses. Many <br />counties and municipalities have adopted detention policies. <br />Counties have direct statutory authority to impose these <br />pOlicies; whereas, cities accomplish the task through authority <br />granted through public works programs. <br /> <br />... <br /> <br />Formulation of Improvement Districts <br /> <br />Since no on-going programs exist within state government for <br />providing direct financial assistance for alleviating flood <br />problems, there are authorities for the establishment of <br />single-purpose and multi-purpose improvement districts to <br />construct projects. <br /> <br />Conservancy Law of Colorado - This authority is effective <br />for large basins which cross local jurisdictional boundaries. <br />The authority can be used to establish a conservancy district for <br />flood control or multi-purpose water resources studies and <br />projects. <br /> <br />County Public Improvement Districts - For localized flood <br />control and drainage problems the Board of County Commissioner <br />can assist in the formulation of Improvement Districts to sponsor <br />a project through the following procedures: <br /> <br />. 30-20-501 CRS 1973 et. seq. - The county can respond to a <br />petition by the land owners in the service area. <br /> <br />. 30-20-601 CRS 1973 et seq. - The County can form a district <br />by resolution for a service area. <br /> <br />. <br /> <br />Regional Improvement Districts - Authority exists for the <br />formulation of special purpose districts. Certain water and <br />storm sewer districts can be formed under these authorities. <br />The opportunity also exists for the formulation of a special <br />districts similar to the Urban Drainage and Flood Control <br />District, Denver Metropolitan Region. <br /> <br />-3- <br />
